1. Contractual Relationship

1.1 Applicability

These Terms of Use (“Terms”) govern your access to and use of the applications, websites, content, products and services (collectively, the “Services”) made available by MILES GO RIDE, India, regardless of the country from which you access them.

1.2 Acceptance of Terms

• By accessing or using the Services, you acknowledge and agree to be legally bound by these Terms. This establishes a contractual relationship between you and MILES GO RIDE.
• If you do not agree with these Terms, you must not access or use the Services.
• These Terms supersede any and all prior agreements or arrangements between you and MILES GO RIDE.
• MILES GO RIDE reserves the right, at its sole discretion, to terminate these Terms, suspend or discontinue any Service (in whole or in part), or restrict your access to the Services at any time, without prior notice, for any reason whatsoever.

1.3 Supplemental Terms

• Certain Services may be subject to supplemental terms, such as specific policies for events, activities, or promotions (“Supplemental Terms”).
• Supplemental Terms will be disclosed to you in connection with the relevant Service and shall be deemed a part of these Terms.
• In the event of any conflict, the Supplemental Terms shall prevail with respect to the applicable Service.

1.4 Information Sharing

• In case of a complaint, dispute, or conflict (including accidents) involving you and a Third-Party Provider (such as a transportation network company driver), MILES GO RIDE may share necessary information—including your contact details—with an insurer, claims processor, or other relevant party.
• Such sharing shall be limited to what is reasonably required for the resolution of the complaint, dispute, or conflict.

2. The Services

2.1 Nature of Services

The Services provided by MILES GO RIDE constitute a cab/taxi booking and transportation facilitation platform. Through mobile applications, websites, or designated phone numbers (each, an “Application”), users may arrange and schedule transportation services with independent third-party transportation providers that are under agreement with MILES GO RIDE or its affiliates.
Unless otherwise agreed under a separate written contract, the Services are provided solely for personal, non-commercial use.

2.2 License

2.2.1 Grant of License

Subject to your continued compliance with these Terms, MILES GO RIDE grants you a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to:

• Access and use the Application on your personal device solely in connection with your use of the Services; and
• Access and use any content, information, or related materials made available through the Services, strictly for your personal, non-commercial use.

All rights not expressly granted herein are reserved by MILES GO RIDE and its licensors.

2.3 Restrictions

2.3.1 Prohibited Uses

You agree that you shall not, under any circumstances:
i. Remove, alter, or obscure any copyright, trademark, or proprietary notices from any part of the Services;
ii. Copy, reproduce, modify, create derivative works from, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast, or otherwise exploit the Services, except as expressly permitted by MILES GO RIDE;
iii. Decompile, reverse engineer, or disassemble the Services, except where permitted by applicable law;
iv. Link to, mirror, or frame any portion of the Services without prior written consent;
v. Launch or cause the launching of any automated programs, bots, scripts, or tools for data scraping, indexing, surveying, or otherwise data mining any part of the Services, or for the purpose of burdening or hindering the operation of the Services;
vi. Attempt to gain unauthorized access to, impair, or interfere with any portion of the Services, or any related systems or networks.

2.4 Provision of Services

2.4.1 Service Providers

You acknowledge that the Services may be provided under different request options by, or in connection with:
i. Certain subsidiaries or affiliates of MILES GO RIDE; and/or
ii. Independent third-party providers, including but not limited to licensed transportation network drivers, transportation charter permit holders, or holders of similar transportation permits and authorizations.

2.5 Third-Party Services and Content

2.5.1 External Services

The Services may be integrated with or made accessible in connection with third-party services or content, including advertisements, that are not controlled by MILES GO RIDE. You acknowledge that:

• Different terms of use and privacy policies may govern your use of such third-party services and content;
• MILES GO RIDE does not endorse and is not responsible or liable for, any products, services, or content made available by such third parties.

2.6 Ownership

2.6.1 Intellectual Property Rights

The Services and all rights therein remain the sole property of MILES GO RIDE or its licensors. Nothing in these Terms grants you:
i. Any ownership rights or interest in or related to the Services, other than the limited license expressly granted under Section 2.2; or
ii. Any right to use, reference, or exploit in any manner the company names, logos, product or service names, trademarks, or service marks of MILES GO RIDE or its licensors.

3. Your Use of the Services

3.1 User Accounts

3.1.1 To access and use most features of the Services, you must register for and maintain an active personal Services account (“Account”). You must be at least 18 years of age to create an Account. During registration, you will be required to provide certain personal information to MILES GO RIDE, including but not limited to your name, address, mobile number, and email address.

You agree to maintain accurate, complete, and up-to-date Account information at all times. Failure to do so may result in your inability to access the Services or termination of your Account.

You are solely responsible for all activities conducted under your Account and shall indemnify and hold harmless MILES GO RIDE against any claims, damages, or liabilities arising from such activities. You agree to maintain the confidentiality of your Account credentials and shall not share your password with any third party. Unless otherwise permitted in writing by MILES GO RIDE, you may only hold one (1) Account.

3.1.2 You may also register as a Sales Partner (including but not limited to affiliate partner, travel agent partner, or API partner). As a Sales Partner, you will generate business for MILES GO RIDE through your channels in exchange for sales commission, subject to applicable partner policies. These Terms shall apply equally to Sales Partners and end-users availing Services through such Sales Partners.

3.2 User Requirements and Conduct

3.2.1 The Services are strictly not available to individuals under the age of 18. You may not authorize third parties to use your Account. Persons under 18 years of age may only use transportation Services if accompanied by you. You shall not transfer, assign, or otherwise share your Account with any third party.

You agree to comply with all applicable laws while using the Services and shall only use the Services for lawful purposes (e.g., no transport of unlawful, restricted, or hazardous materials).

• Services are valid only for the specific destinations booked and cannot be diverted to additional or alternative points, even if the total distance included in the package has not been fully utilized.
• For outstation trips, local city travel at the pickup location is excluded unless explicitly included in the itinerary.
• If you terminate the trip prematurely, no refund, adjustment, or partial compensation will be provided.
• For one-way trips, only one pickup and one drop are included; additional pickups, drops, or stoppages may attract additional charges.
• Air-conditioning (AC) will remain switched off in hilly areas or where operationally necessary.
• You must not cause nuisance, inconvenience, property damage, or misconduct during your use of the Services.
• Consumption of alcohol, narcotics, and smoking is strictly prohibited.

3.2.2 You shall not demand specific vehicle brands, fuel types, registration numbers, or features not expressly committed at the time of booking.

• For Sedan bookings, any 4+1 seat car may be provided; for SUV bookings, any 6+1 seat car may be provided.
• Tempo Traveller bookings are not guaranteed to have AC.
• Luggage allowance will be subject to prevailing safety standards.
• You may be required to furnish valid proof of identity before accessing the Services; refusal may result in denial of service without refund.

3.2.3 MILES GO RIDE does not discriminate between drivers, third-party providers, or customers on the basis of religion, caste, gender, or age. Any cancellation, modification, or refund requests on such grounds will be rejected, and any advance paid will be forfeited.

3.2.4 Refunds, cancellations, or compensation will not be entertained on account of third-party conduct unless it constitutes grave misconduct (e.g., sexual harassment). MILES GO RIDE retains sole discretion to investigate and evaluate such claims on a case-by-case basis. While the Company endeavours to ensure a dignified and hassle-free ride experience, it assumes no liability for third-party behaviour beyond legal obligations.

3.3 Text Messaging

3.3.1 By creating or activating an Account, you consent to receive transactional and operational SMS/text messages from MILES GO RIDE as part of normal business operations.

3.4 Promotional Codes

3.4.1 MILES GO RIDE may, at its sole discretion, issue promotional codes (“Promo Codes”) that may be redeemed for Account credits, discounts, or other benefits. Promo Codes are subject to additional terms communicated at the time of issuance and:

• Must be used only for their intended purpose and audience;
• May not be sold, transferred, duplicated, or made public unless expressly authorized by MILES GO RIDE;
• May be revoked, disabled, or modified at any time without liability;
• Are not redeemable for cash;
• May expire prior to use;
• May be withheld or adjusted in cases of misuse, fraud, or error.

3.5 User-Provided Content

3.5.1 You may submit or upload text, images, audio, video, or feedback through the Services (“User Content”). By providing User Content, you grant MILES GO RIDE a worldwide, perpetual, irrevocable, royalty-free, transferable license, with rights to sublicense, to use, reproduce, modify, distribute, display, and exploit such User Content across all media channels for business purposes.

3.5.2 You represent and warrant that you are the sole owner or hold all necessary rights to grant such license and that your User Content does not infringe upon third-party rights, including intellectual property, privacy, or publicity rights.

3.5.3 You agree not to provide unlawful, defamatory, obscene, offensive, or otherwise inappropriate content. MILES GO RIDE reserves the right (but not the obligation) to review, monitor, or remove User Content at its sole discretion.

3.6 Network Access and Devices

3.6.1 You are solely responsible for securing the data network access required to use the Services. Mobile data charges, SMS fees, and other connectivity costs shall be borne by you.

3.6.2 You are responsible for procuring and updating compatible devices necessary to access the Services. MILES GO RIDE does not guarantee that the Services will function on all devices or operating systems and shall not be liable for any downtime, delays, or errors caused by internet or electronic communication failures.

4. Payment

4.1 Charges

You acknowledge that use of the Services may result in charges for the services or goods you receive from Third Party Providers (“Charges”). Miles Go Ride will facilitate the payment of applicable Charges on behalf of the Third Party Provider, acting as its limited payment collection agent. Payment made in this manner shall be deemed equivalent to payment made directly by you to the Third Party Provider. Charges are inclusive of applicable taxes where required by law. All Charges paid are final and non-refundable, except as determined by Miles Go Ride in its sole discretion.

4.2 Payment Process

All Charges are due immediately upon completion of the service. Payment will be processed by Miles Go Ride, after which a receipt will be provided electronically to you.

4.3 Modification of Charges

Miles Go Ride reserves the right to establish, revise, or remove Charges at its sole discretion. Charges may vary depending on demand, geographical location, or other applicable factors. Promotional offers or discounts may be offered to certain users at Miles Go Ride’s discretion. Such offers have no bearing on your Charges unless they are expressly made available to you.

Wallet funds, vouchers, or discounts provided by Miles Go Ride may be applied only against advance booking amounts and not against the total trip price. Miles Go Ride reserves the right to withdraw or cancel such benefits at any time. Cancellation of a booking prior to order confirmation and/or advance payment may result in forfeiture of the advance and/or a cancellation fee.

4.4 Gratuities

Miles Go Ride does not designate any portion of payment as a tip or gratuity to our Driver partners / Third-Party Provider. You are free to provide gratuities at your discretion, but such payments are voluntary and not required.

4.5 Unauthorized Payments

You shall not make any direct payments to our Driver partners / Third-Party Providers outside the platform, either before boarding or during the ride. Miles Go Ride shall not be liable for any extra payments made directly to drivers beyond the fare communicated through the application.

4.6 Additional Charges (Taxes, Tolls, Parking)

You are responsible for paying any tolls, inter-state taxes, parking charges, or other fees incurred during the trip, unless included in the trip package. Receipts for such charges must be collected directly from the Third Party Provider/our Driver partner. Miles Go Ride is not liable for providing invoices for payments outside of trip fare inclusions.

4.7 Shortened Trips

You remain liable for the full trip package price in the event you shorten your trip (e.g., early return, unused kilometers or reduced travel time). No refunds, cashback, or vouchers will be provided in such cases.

4.8 Extended Trips

If your round trip extends beyond the scheduled return date and time:

• An additional fee of INR 250 per hour will apply between 12:00 AM and 3:00 AM.
• Trips extended beyond 3:00 AM will incur a full extra day’s charge (calculated as 250 km × applicable per km fare).

4.9 Add-on Services

• Charges for Add-on services (e.g., “Upgrade to Refundable Booking”) are non-refundable under all circumstances.
• If an Add-on service is not delivered, only the charge for that Add-on will be refunded. Trip fares or other unrelated charges shall not be refunded.

4.10 Repair or Cleaning Fees

You are responsible for costs of repair or cleaning of vehicles caused by your actions, beyond normal wear and tear. Verified claims reported by a Third Party Provider may be charged to your account and are non-refundable.

If you are traveling with pets, additional cleaning charges may apply:

• INR 800 for hatchbacks/sedans
• INR 1000 for SUVs/Innova
• INR 2000 for Tempo Travelers or larger vehicles

4.11 Sales Partner Commission

• Miles Go Ride reserves the right to revise commission percentages at any time.
• Only completed trips are eligible for commission payouts. Cancelled trips may result in reversal of commission.
• Minimum withdrawal threshold: INR 2000. Commission payouts will only be made once this threshold is met.
• PAN card details are mandatory for commission payouts, and the name on the PAN card must match the bank account holder’s name.

5. Disclaimers; Limitation of Liability; Indemnity

5.1 Disclaimer

5.1.1 The Services are provided on an “as is” and “as available” basis. MILES GO RIDE disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these Terms, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.1.2 MILES GO RIDE makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the Services, or that the Services will be uninterrupted or error-free.

5.1.3 MILES GO RIDE does not guarantee the quality, suitability, safety, or ability of Third-Party Providers. You agree that the entire risk arising out of your use of the Services and any service or good requested in connection therewith, remains solely with you to the maximum extent permitted under applicable law.

5.2 Limitation of Liability

5.2.1 MILES GO RIDE shall not be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages of any kind, including but not limited to loss of profits, loss of data, personal injury, or property damage, arising out of or in connection with:

• (i) your access to or use of the Services, or your inability to access or use the Services;
• (ii) any transaction or relationship between you and any Third-Party Provider;
• (iii) delays, failures, interruptions, or errors of any kind in the performance of the Services; or
• (iv) any circumstances beyond MILES GO RIDE’s reasonable control.

5.2.2 In no event shall MILES GO RIDE’s total liability to you in connection with the Services for all damages, losses, and causes of action exceed ₹500 (Rupees Five Hundred Only).

5.2.3 You acknowledge that Third-Party Providers may not be professionally licensed or permitted. MILES GO RIDE disclaims liability for:

• (i) non-compliance with COVID-19 or other government-issued guidelines by Third-Party Providers;
• (ii) passes, permits, or medical test reports (including COVID-19 test reports) required for travel; these must be arranged by you at your own expense.

5.2.4 You are responsible for verifying that the assigned vehicle and driver match the identification details (license, driver name, vehicle plate number) provided by MILES GO RIDE. If you choose to ride with a driver or vehicle not verified by MILES GO RIDE, you shall be solely responsible for all consequences, including damages not less than ₹10,000 (Rupees Ten Thousand Only), payable to MILES GO RIDE. In such cases, no refund shall be provide and disputes must be resolved directly with the Third-Party Provider.

5.2.5 MILES GO RIDE is not liable for missed trains, flights, events, or any delays arising from factors outside its control (including natural calamities, traffic, accidents, strikes, or governmental restrictions). In such cases, the standard Cancellation & Refund Policy shall apply.

5.2.6 A Third-Party Provider or Driver may be assigned at a reasonable time prior to your scheduled ride.

5.2.7 In the event of a vehicle delay exceeding 30 minutes (where pickup details were correctly provided), MILES GO RIDE shall only assist in connecting you with the assigned Driver or Third-Party Provider. No refund of the advance booking amount shall be made.

5.2.8 Complaints must be raised within 3 business days of the scheduled ride completion. Complaints made thereafter will not be entertained.

5.2.9 MILES GO RIDE reserves the right to cancel any booking at its sole discretion at any time.

5.2.10 MILES GO RIDE is not responsible for damages caused by technical errors, network issues, malware, incorrect contact numbers, or incomplete/incorrect information on the Site or Application.

5.2.11 Baggage limits: maximum of 2 bags in sedans and 4 bags in larger vehicles (e.g., SUV, Innova). Each bag must not exceed 158 cm (62.2 in) combined dimensions and 32 kg weight.

5.2.12 You are solely responsible for your belongings. MILES GO RIDE will make “best-effort” attempts to help locate lost items but assumes no liability for their recovery or condition. Lost items may be collected from the designated office after 3 working days, or, if delivery is requested within 20 km of the office, a flat fee of in range ₹500- ₹1000 (Rupees Five Hundred or One thousand Only) will be charged.

5.2.13 MILES GO RIDE does not guarantee uninterrupted availability of the Services.

5.2.14 All communication, including booking confirmations, status updates, and program benefits, will be sent to your registered mobile number and/or email. MILES GO RIDE is not liable for communication failures due to incorrect or inactive contact details provided by you.

5.3 Indemnity

5.3.1 You agree to indemnify, defend, and hold harmless MILES GO RIDE, its affiliates, officers, directors, employees, and agents from any and all claims, demands, losses, liabilities, or expenses (including attorneys’ fees) arising from or in connection with:

• (i) your use of the Services or any goods obtained through the Services;
• (ii) your breach of these Terms;
• (iii) MILES GO RIDE’s use of your submitted User Content; or
• (iv) your violation of the rights of any third party, including Third-Party Providers.

6. Governing Law; Arbitration

6.1 These Terms shall be governed by and construed in accordance with the laws of India.

6.2 Any dispute, claim, or controversy arising out of or in connection with these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Site, Application, or Services (collectively, “Disputes”), shall first be attempted to be resolved amicably through negotiation and consultation at such office location of MILES GO RIDE as may be designated.

6.3 If the Dispute is not resolved within thirty (30) days of good faith negotiations, such Dispute shall be referred to and finally settled by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. If such Act ceases to be in force, the Dispute shall be resolved in accordance with the applicable law governing arbitration in India at that time.

6.4 The arbitration proceedings shall be conducted as follows:

• Each party shall appoint one arbitrator and the two appointed arbitrators shall jointly appoint a third/presiding arbitrator.
• The seat and venue of arbitration shall be Ahmedabad, Gujarat, India.
• The arbitration shall be conducted in the English/Hindi/Gujarati language.

6.5 Subject to the arbitration clause above, the courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over all matters arising under or in connection with these Terms.

7. Other Provisions

7.1 Claims of Copyright Infringement

7.1.1 Any claims of copyright infringement relating to the Services should be directed to Miles Go Ride. Please refer to www.milesgoride.com for the designated address and additional information.

7.2 Notices

7.2.1 Miles Go Ride may provide notices by any of the following means:

• By posting a general notice on the Services,
• By sending an email to the email address registered in your Account,
• By sending a text message (SMS) to the mobile number registered in your Account, or
• By written communication to the address provided in your Account.

7.2.2 You may send notices to Miles Go Ride by email – support@milesgoride.com

7.3 General

7.3.1 You may not assign or transfer these Terms, in whole or in part, without the prior written consent of Miles Go Ride.

7.3.2 Miles Go Ride may assign or transfer these Terms, in whole or in part, without restriction, including but not limited to:
(i) a subsidiary or affiliate,
(ii) an acquirer of Miles Go Ride’s equity, business, or assets, or
(iii) a successor entity pursuant to a merger.

7.3.3 No joint venture, partnership, employment, or agency relationship exists between you, Miles Go Ride, or any Third-Party Provider as a result of these Terms or your use of the Services.

OTHERS TERMS & CONDITIONS:

• Do not ride in a vehicle unless it has a valid commercial license. **
• Do not ride if the vehicle and driver information do not match the details provided to you. **
• Miles Go Ride is not responsible or liable** in any way if you choose to ride in a vehicle that is not commercially licensed or with a driver other than the one assigned to you.
• Once you have completed cab and driver verification at the start of the journey, Miles Go Ride is only responsible for the driver as per our assignment. After the customer is matched with the driver, Miles Go Ride will not be responsible for anything that happens during the journey.

• Driver Verification: The driver may request to see your identification (such as Aadhaar card, PAN card) before starting the journey.
• Definition of a Day: One day means a full calendar day (from midnight 12:00 to the following midnight 12:00).Distance Calculation: Distance will be measured using Google Maps based on the exact travel route and location. If the distance travelled exceeds the booked kilometers, additional kilometers will be charged according to the standard criteria.
• Toll, State Tax, and Parking: All toll taxes, state (border) taxes, and parking fees are to be paid by the customer as per actuals. These are **not included** in the booking amount. Any required airport entrance fee, parking or entry fee is also the customer’s responsibility.
• Luggage and Passengers: No extra passengers or luggage in excess of the stated vehicle category are permitted.
• Vehicle Model Guarantees: Upon booking with Miles Go Ride, we can only assure you of the vehicle category, not a specific model. We **cannot guarantee the availability of any specific vehicle model** for your trip. No refund will be provided if a particular model is not available or supplied.
• Driver Meals: The driver will arrange for his own meals during the journey.
• Customer Conduct: Please do not pressure the driver to speed. The safety of all passengers is paramount.
• Payment: The balance payment is due at the beginning of the journey.
• Loss & Damages: Miles Go Ride is not liable for any material or immaterial losses incurred through the use of its services. These losses will not be eligible for any form of compensation.
• Fare Calculations: One way or round-trip fares are subject to various terms and may differ for certain states and tourist destinations. Any additional pick-up or drop-off points will incur additional appropriate charges.
• Additional Charges: The customer is responsible for all extra fees and costs incurred during the journey that are not included in the booking.

1. કરારાત્મક સંબંધ

1.1 લાગુ પડતા નિયમો

આ ઉપયોગની શરતો (“શરતો”) તમારા માટે ઉપલબ્ધ કરાવવામાં આવેલા એપ્લિકેશનો, વેબસાઇટો, સામગ્રી, પ્રોડક્ટ્સ અને સેવાઓ (એકત્રિત રીતે “સેવાઓ”) પર તમારી ઍક્સેસ અને ઉપયોગને નિયમિત કરે છે, જે MILES GO RIDE, ભારત દ્વારા પૂરી પાડવામાં આવે છે, તમે કયા દેશમાં તેને ઍક્સેસ કરો છો તેનાથી સ્વતંત્ર.

1.2 શરતોની સ્વીકાર્યતા

• સેવાઓને ઍક્સેસ અથવા ઉપયોગ કરીને, તમે કાનૂની રીતે આ શરતોના પાલન માટે બાધ્ય થવાનો સ્વીકાર કરો છો. આ તમારાં અને MILES GO RIDE વચ્ચે કરારાત્મક સંબંધ બનાવે છે.
• જો તમે આ શરતો સાથે સંમત ન હો, તો તમને સેવાઓ ઍક્સેસ અથવા ઉપયોગ કરવાની મંજૂરી નથી.
• આ શરતો તમારાં અને MILES GO RIDE વચ્ચેના તમામ અગાઉના કરાર કે ગોઠવણોને બદલે છે.
• MILES GO RIDE ને સંપૂર્ણ અધિકાર છે કે તે પોતાની મરજી મુજબ આ શરતોને સમાપ્ત કરે, કોઈ પણ સેવા (પૂર્ણ કે અંશતઃ)ને સ્થગિત કે બંધ કરી દે, અથવા તમારી ઍક્સેસને કોઈ પણ સમયે, કોઈ પણ કારણસર, પૂર્વ સૂચના વિના મર્યાદિત કરે.

1.3 પૂરક શરતો

• કેટલીક સેવાઓ પૂરક શરતોના વિષય હોઈ શકે છે, જેમ કે ઇવેન્ટ્સ, પ્રવૃત્તિઓ અથવા પ્રમોશન માટેની ખાસ નીતિઓ (“પૂરક શરતો”).
• પૂરક શરતો તમને સંબંધિત સેવા સાથે જાહેર કરવામાં આવશે અને આ શરતોનો ભાગ માનવામાં આવશે.
• કોઈ પણ વિસંગતતા થાય ત્યારે, સંબંધિત સેવા માટે પૂરક શરતો પ્રબળ રહેશે.

1.4 માહિતી વહેંચણી

• આવી માહિતી વહેંચણી ફક્ત ફરિયાદ, વિવાદ અથવા અથડામણના ઉકેલ માટે જરૂરી હદ સુધી જ મર્યાદિત રહેશે.

2. સેવાઓ

2.1 સેવાઓનું સ્વરૂપ

MILES GO RIDE દ્વારા પ્રદાન કરવામાં આવેલી સેવાઓમાં ટેક્સી/કૅબ બુકિંગ અને પરિવહન સુવિધા પ્લેટફોર્મનો સમાવેશ થાય છે. મોબાઈલ એપ્લિકેશન, વેબસાઈટ્સ અથવા નિર્ધારિત ફોન નંબરો (પ્રત્યેકને “એપ્લિકેશન” કહેવામાં આવે છે) મારફતે, વપરાશકર્તાઓ સ્વતંત્ર તૃતીય-પક્ષ પરિવહન પ્રદાતાઓ (જે MILES GO RIDE અથવા તેની સંલગ્ન સંસ્થાઓ સાથે કરાર હેઠળ છે) સાથે પરિવહન સેવાઓનું આયોજન અને નિર્ધારણ કરી શકે છે.

જો સુધી અલગ લખિત કરાર હેઠળ સહમત ન થાય, સેવાઓ ફક્ત વ્યક્તિગત, ગેર-વ્યવસાયિક ઉપયોગ માટે જ પ્રદાન કરવામાં આવે છે.

2.2 લાઇસન્સ

2.2.1 લાઇસન્સની મંજૂરી

આ શરતોનું સતત પાલન કરવાના આધાર પર, MILES GO RIDE તમને સીમિત, ગેર-વિશિષ્ટ, ગેર-સબલાઇસેન્સ કરવા યોગ્ય, રદ કરી શકાય તેવું અને ગેર-હસ્તાંતરણયોગ્ય લાઇસન્સ આપે છે, જેના આધારે તમે:

• તમારી વ્યક્તિગત ડિવાઇસ પર ફક્ત સેવાઓના ઉપયોગ સાથે સંકળાયેલા હેતુ માટે એપ્લિકેશન ઍક્સેસ અને ઉપયોગ કરી શકો છો; અને
• સેવાઓ મારફતે ઉપલબ્ધ કરવામાં આવેલી કોઈપણ સામગ્રી, માહિતી અથવા સંબંધિત સામગ્રીને ફક્ત વ્યક્તિગત, ગેર-વ્યવસાયિક ઉપયોગ માટે ઍક્સેસ અને ઉપયોગ કરી શકો છો.

અહીં સ્પષ્ટ રીતે આપેલા હક્કો સિવાયના તમામ હક્કો MILES GO RIDE અને તેના લાઇસન્સ ધારકો પાસે અનામત છે.

2.3 મર્યાદાઓ

2.3.1 પ્રતિબંધિત ઉપયોગ

તમે સંમત છો કે તમે કોઈ પણ પરિસ્થિતિમાં નીચેના કાર્ય નહીં કરો:

i. સેવાઓના કોઈપણ ભાગમાંથી કૉપીરાઇટ, ટ્રેડમાર્ક અથવા માલિકી સંબંધિત સૂચનાઓ દૂર કરવી, બદલવી અથવા અસ્પષ્ટ કરવી;
ii. સેવાઓની નકલ કરવી, પુનઃઉત્પાદિત કરવી, ફેરફાર કરવો, અનુસર્જિત કૃતિઓ બનાવવી, વિતરણ કરવું, લાઇસન્સ આપવું, ભાડે આપવું, વેચવું, ફરી વેચવું, હસ્તાંતર કરવું, જાહેર પ્રદર્શિત કરવું, જાહેર પ્રદર્શન કરવું, ટ્રાન્સમિટ કરવું, સ્ટ્રીમ કરવું, પ્રસારિત કરવું અથવા અન્ય રીતે શોષણ કરવું, સિવાય કે MILES GO RIDE દ્વારા સ્પષ્ટ રીતે મંજૂરી આપવામાં આવી હોય;
iii. લાગુ કાયદા મુજબ પરવાનગી સિવાય સેવાઓને ડીકમ્પાઇલ, રિવર્સ એન્જિનિયર કે ડિસએસેમ્બલ કરવી;
iv. પૂર્વલખિત મંજૂરી વિના સેવાઓના કોઈપણ ભાગને લિંક કરવો, પ્રતિબિંબિત કરવો કે ફ્રેમ કરવું;
v. સ્વચાલિત પ્રોગ્રામ્સ, બોટ્સ, સ્ક્રિપ્ટ્સ અથવા ટૂલ્સ શરૂ કરવી અથવા શરૂ કરાવવી—ડેટા સ્ક્રેપિંગ, ઇન્ડેક્સિંગ, સર્વેક્ષણ અથવા ડેટા માઇનિંગ કરવા માટે, અથવા સેવાઓના કાર્યમાં અવરોધ કે ભારણ લાવવા માટે;
vi. સેવાઓ અથવા કોઈપણ સંબંધિત સિસ્ટમ્સ અથવા નેટવર્ક્સમાં અનધિકૃત ઍક્સેસ મેળવવાનો પ્રયાસ કરવો, તેમને નુકસાન પહોંચાડવું અથવા તેમની કામગીરીમાં હસ્તક્ષેપ કરવો.

2.4 સેવાઓનું પ્રદાન

2.4.1 સેવા પ્રદાતાઓ

તમે સ્વીકારો છો કે સેવાઓ નીચેના આધાર પર પ્રદાન થઈ શકે છે:

i. MILES GO RIDE ની કેટલીક પેટાકંપનીઓ અથવા સંલગ્ન સંસ્થાઓ દ્વારા; અને/અથવા
ii. સ્વતંત્ર તૃતીય-પક્ષ પ્રદાતાઓ દ્વારા, જેમાં લાઇસન્સ ધરાવતા પરિવહન નેટવર્ક ડ્રાઇવરો, પરિવહન ચાર્ટર પરમિટ ધારકો અથવા સમાન પરિવહન પરમિટ અને અધિકૃતતા ધરાવતા અન્ય પ્રદાતાઓનો સમાવેશ થાય છે.

2.5 તૃતીય–પક્ષ સેવાઓ અને સામગ્રી

2.5.1 બાહ્ય સેવાઓ

સેવાઓ તૃતીય-પક્ષ સેવાઓ અથવા સામગ્રી (જેમ કે જાહેરાતો) સાથે સંકલિત અથવા ઉપલબ્ધ હોઈ શકે છે, જે MILES GO RIDE દ્વારા નિયંત્રિત નથી. તમે સ્વીકારો છો કે:

• આવી તૃતીય-પક્ષ સેવાઓ અને સામગ્રીના ઉપયોગ પર જુદી જુદી શરતો અને ગોપનીયતા નીતિઓ લાગુ પડી શકે છે;
• MILES GO RIDE આવા તૃતીય-પક્ષો દ્વારા ઉપલબ્ધ કરાવવામાં આવેલા કોઈપણ પ્રોડક્ટ્સ, સેવાઓ અથવા સામગ્રી માટે ન તો જવાબદાર છે ન તો દાયિત્વ ધરાવે છે.

2.6 માલિકી હક્કો

2.6.1 બૌદ્ધિક સંપત્તિ હક્કો

સેવાઓ અને તે સંબંધિત તમામ હક્કો માત્ર MILES GO RIDE અથવા તેના લાઇસન્સ ધારકોની માલિકીમાં રહે છે. આ શરતોમાં કશું પણ તમને નીચેના હક્કો આપતું નથી:

i. સેવાઓ સંબંધિત અથવા તેમાં માલિકીના હક્કો અથવા હિત—સિવાય તે સીમિત લાઇસન્સના જે કલમ 2.2 હેઠળ સ્પષ્ટ રીતે આપવામાં આવ્યું છે; અથવા
ii. MILES GO RIDE અથવા તેના લાઇસન્સ ધારકોના કંપની નામો, લોગોઝ, પ્રોડક્ટ અથવા સેવા નામો, ટ્રેડમાર્ક અથવા સેવા ચિન્હોનો કોઈપણ રીતે ઉપયોગ, સંદર્ભ કે શોષણ કરવાનો હક્ક.

3. તમારી સેવાઓનો ઉપયોગ

3.1 યુઝર એકાઉન્ટ્સ

3.1.1 સેવાઓની મોટાભાગની સુવિધાઓ મેળવવા અને તેનો ઉપયોગ કરવા માટે તમારે સક્રિય વ્યક્તિગત સર્વિસ એકાઉન્ટ (“એકાઉન્ટ”) નોંધણી કરવું અને જાળવવું પડશે. એકાઉન્ટ બનાવવા માટે તમારી ઉંમર ઓછામાં ઓછી 18 વર્ષ હોવી જરૂરી છે. નોંધણી દરમ્યાન તમારે MILES GO RIDE ને ચોક્કસ વ્યક્તિગત માહિતી આપવી પડશે, જેમાં તમારું નામ, સરનામું, મોબાઇલ નંબર અને ઇમેઇલ સરનામું સામેલ છે.

તમે હંમેશા સાચી, સંપૂર્ણ અને અપડેટેડ એકાઉન્ટ માહિતી જાળવવા સંમત થાઓ છો. તે ન કરવા પર તમને સેવાઓની ઍક્સેસ ન મળી શકે અથવા તમારું એકાઉન્ટ રદ થઈ શકે છે.

તમારા એકાઉન્ટ હેઠળ થતી બધી પ્રવૃત્તિઓ માટે તમે એકમાત્ર જવાબદાર છો અને આવી પ્રવૃત્તિઓથી ઉદ્ભવતા કોઈપણ દાવા, નુકસાન અથવા જવાબદારીઓ માટે MILES GO RIDE ને નિર્દોષ ઠેરવશો. તમે એકાઉન્ટ ક્રેડેન્શિયલ્સની ગુપ્તતા જાળવશો અને તમારો પાસવર્ડ કોઈ તૃતીય પક્ષ સાથે શેર નહીં કરો. MILES GO RIDE ની લેખિત પરવાનગી વિના, તમે માત્ર એક (1) એકાઉન્ટ રાખી શકો છો.

3.1.2 તમે સેલ્સ પાર્ટનર તરીકે પણ નોંધણી કરી શકો છો (જેમાં સહભાગી પાર્ટનર, ટ્રાવેલ એજન્ટ પાર્ટનર, અથવા API પાર્ટનરનો સમાવેશ થાય છે). સેલ્સ પાર્ટનર તરીકે, તમે તમારા માધ્યમોથી MILES GO RIDE માટે બિઝનેસ જનરેટ કરશો અને લાગુ નીતિઓ મુજબ વેચાણ કમિશન મેળવશો. આ નિયમો સેલ્સ પાર્ટનર્સ અને એન્ડ-યૂઝર્સ બંને પર સમાનપણે લાગુ પડશે.

3.2 યુઝર જરૂરીયાતો અને વર્તણૂંક

3.2.1 પાત્રતા અને પ્રતિબંધો

• સેવાઓ 18 વર્ષથી ઓછી ઉંમરના વ્યક્તિઓ માટે ઉપલબ્ધ નથી.
• તમે તૃતીય પક્ષને તમારું એકાઉન્ટ વાપરવા અધિકૃત નહીં કરો.
• 18 વર્ષથી ઓછી ઉંમરના વ્યક્તિઓ માત્ર તમારા સાથોસાથ જ સેવા લઈ શકે.
• તમારે લાગુ કાયદાનું પાલન કરવું પડશે અને સેવા ફક્ત કાયદેસર હેતુ માટે જ વાપરવી પડશે (જેમ કે ગેરકાયદે અથવા જોખમી સામાનનું પરિવહન નહીં).

વિશેષ સેવા શરતો:

• સેવાઓ ફક્ત બુક કરેલી ડેસ્ટિનેશન્સ માટે માન્ય છે, વધારાના અથવા વિકલ્પ માર્ગ માટે નથી.
• આઉટસ્ટેશન ટ્રિપમાં પિકઅપ લોકેશનની સ્થાનિક મુસાફરી સામેલ નથી, જો સુધી ખાસ દર્શાવવામાં ન હોય.
• જો તમે ટ્રિપ સમય પહેલાં બંધ કરો તો કોઈ રિફંડ અથવા એડજસ્ટમેન્ટ નહીં મળે.
• વન-વે ટ્રિપમાં ફક્ત એક પિકઅપ અને એક ડ્રોપ સામેલ છે; વધારાની સ્ટોપેજ માટે વધારાનો ચાર્જ લાગશે.
• હિલી એરિયામાં અથવા જરૂરીયાત મુજબ AC બંધ રહેશે.
• સેવા ઉપયોગ દરમ્યાન તમને ન્યુસન્સ, અસુવિધા, પ્રોપર્ટી ડેમેજ કે દુર્વ્યવહાર કરવો નહીં.
• દારૂ, નશીલા પદાર્થો અને ધુમ્રપાન સખત પ્રતિબંધિત છે.

3.2.2 વાહન અને સર્વિસ ફાળવણી

• તમે ચોક્કસ બ્રાન્ડ, ફ્યુઅલ ટાઇપ, રજિસ્ટ્રેશન નંબર કે અન્ય લક્ષણોની માંગણી નહીં કરો.
• સેડાન બુકિંગ માટે કોઈપણ 4+1 સીટ કાર આપવામાં આવશે; SUV માટે કોઈપણ 6+1 સીટ કાર આપવામાં આવશે.
• ટેમ્પો ટ્રાવેલર બુકિંગમાં AC ગેરંટી નથી.
• સામાનની મંજૂરી હાલની સલામતી નીતિઓ મુજબ રહેશે.
• સર્વિસ મેળવતા પહેલાં માન્ય ઓળખ પુરાવો માંગવામાં આવી શકે છે; ના પાડવાથી સર્વિસ આપવાનો ઇનકાર કરવામાં આવશે અને રિફંડ નહીં મળે.

3.2.3 અસ્પૃશ્યતા વિરોધ
MILES GO RIDE ડ્રાઈવર, તૃતીય-પક્ષ પ્રદાતાઓ અથવા ગ્રાહકો વચ્ચે ધર્મ, જાતિ, લિંગ અથવા ઉંમરના આધારે ભેદભાવ કરતું નથી. આવા આધાર પર કરેલી કોઈપણ રદ, ફેરફાર અથવા રિફંડ વિનંતી નામંજૂર કરવામાં આવશે અને અગાઉ ચૂકવેલી રકમ જપ્ત કરવામાં આવશે.

3.2.4 તૃતીય–પક્ષ વર્તન
ડ્રાઈવર અથવા પ્રદાતા વર્તન માટે રિફંડ, રદ અથવા વળતર આપવામાં નહીં આવે, જો સુધી તે ગંભીર દુર્વ્યવહાર (જેમ કે જાતીય હેરાસમેન્ટ) ના હોય. MILES GO RIDE પાસે આવી ઘટનાઓની તપાસ કરવાની સંપૂર્ણ છૂટ છે, પરંતુ કાનૂની ફરજથી આગળ કોઈ જવાબદારી નહીં સ્વીકારે.

3.3 ટેક્સ્ટ મેસેજિંગ

3.3.1 એકાઉન્ટ બનાવીને અથવા સક્રિય કરીને, તમે MILES GO RIDE તરફથી વ્યવહારિક અને ઓપરેશનલ SMS/ટેક્સ્ટ મેસેજીસ મેળવવા સંમત થાઓ છો.

3.4 પ્રમોશનલ કોડ્સ

3.4.1 MILES GO RIDE પોતાના વિવેકાધિકારે પ્રમોશનલ કોડ્સ (“પ્રોમો કોડ્સ”) જારી કરી શકે છે, જે એકાઉન્ટ ક્રેડિટ, ડિસ્કાઉન્ટ અથવા અન્ય લાભ માટે વપરાઈ શકે છે. પ્રોમો કોડ્સ નીચે મુજબ રહેશે:

• ફક્ત નિર્ધારિત હેતુ અને પ્રેક્ષકો માટે વાપરવા યોગ્ય રહેશે;
• MILES GO RIDE ની મંજૂરી વિના વેચવા, ટ્રાન્સફર કરવા અથવા જાહેર કરવા પર પ્રતિબંધ રહેશે;
• કોઈપણ સમયે રદ, અક્ષમ અથવા બદલવામાં આવી શકે છે;
• રોકડ રૂપે રિડીમ નહીં થાય;
• સમાપ્ત થવાના પહેલાં જ અપ્રયોજ્ય થઈ શકે છે;
• દુરુપયોગ, છેતરપિંડી અથવા ભૂલના કિસ્સામાં રોકી શકાય છે.

3.5 યુઝર–પ્રદાન કરેલું કન્ટેન્ટ

3.5.1 તમે સર્વિસ દ્વારા લખાણ, છબીઓ, ઓડિયો, વીડિયો અથવા પ્રતિસાદ (“યૂઝર કન્ટેન્ટ”) આપી શકો છો. તે આપીને, તમે MILES GO RIDE ને વિશ્વવ્યાપી, કાયમી, અપ્રતિહાર્ય, રોયલ્ટી-ફ્રી, ટ્રાન્સફરેબલ લાયસન્સ આપો છો (સબલાયસન્સનો અધિકાર સાથે) કે જેથી તેઓ તેને વાપરી, નકલ કરી, ફેરફાર કરી, વિતરીત કરી, દર્શાવી શકે.

3.5.2 તમે ખાતરી આપો છો કે આપેલા કન્ટેન્ટના હક તમને છે અને તે કોઈ તૃતીય-પક્ષના બુદ્ધિ સંપત્તિ હકો, ગોપનીયતા અથવા પ્રતિષ્ઠા હકોનું ઉલ્લંઘન કરતું નથી.

3.5.3 તમે ગેરકાયદે, અપમાનજનક, અશ્લીલ, આક્ષેપજનક અથવા અયોગ્ય કન્ટેન્ટ નહીં આપો. MILES GO RIDE પાસે આવું કન્ટેન્ટ સમીક્ષા, મોનિટર અથવા દૂર કરવાની છૂટ છે.

3.6 નેટવર્ક ઍક્સેસ અને ડિવાઇસિસ

3.6.1 સેવાઓનો ઉપયોગ કરવા માટે જરૂરી ડેટા નેટવર્ક ઍક્સેસ મેળવવાની જવાબદારી તમારી છે. મોબાઇલ ડેટા ચાર્જીસ, SMS ફી અને અન્ય કનેક્ટિવિટી ખર્ચ તમારે જ ભરવાના રહેશે.

3.6.2 સેવાઓ મેળવવા માટે જરૂરી સુસંગત ડિવાઇસિસ મેળવવા અને અપડેટ કરવાની જવાબદારી તમારી છે. MILES GO RIDE સેવાઓ તમામ ડિવાઇસિસ અથવા ઓપરેટિંગ સિસ્ટમ્સ પર કાર્ય કરશે તેવી ખાતરી આપતું નથી અને ઇન્ટરનેટ અથવા ઇલેક્ટ્રોનિક સંચારની ખામીઓથી થતી વિલંબ કે ભૂલ માટે જવાબદાર નહીં રહે.

૪. ચુકવણી

૪.૧ ચાર્જીસ

તમે સ્વીકારો છો કે સર્વિસનો ઉપયોગ કરવા બદલ તૃતીય પક્ષ પ્રદાતાઓ (“ચાર્જીસ”) પાસેથી મળેલી સેવાઓ અથવા વસ્તુઓ માટે ચાર્જીસ લાગુ પડી શકે છે. માઈલ્સ ગો રાઈડ તૃતીય પક્ષ પ્રદાતા તરફથી લાગુ પડતા ચાર્જીસની વસૂલાત સુલભ કરશે અને તેમની મર્યાદિત પેમેન્ટ કલેકશન એજન્ટ તરીકે કાર્ય કરશે. આ રીતે કરવામાં આવેલ પેમેન્ટ તૃતીય પક્ષ પ્રદાતાને સીધી ચુકવણી કરેલ સમાન માનવામાં આવશે. જ્યાં કાયદા મુજબ જરૂરી હોય ત્યાં ચાર્જીસમાં લાગુ પડતા ટેક્સ સામેલ રહેશે. તમામ ચાર્જીસ અંતિમ અને નોન-રિફંડેબલ રહેશે, સિવાય કે માઈલ્સ ગો રાઈડ તેના એકમાત્ર વિવેકાધિકારે નક્કી કરે.

૪.૨ પેમેન્ટ પ્રક્રિયા

સર્વિસ પૂર્ણ થયા પછી તરત જ તમામ ચાર્જીસ ચૂકવવા પડશે. માઈલ્સ ગો રાઈડ પેમેન્ટ પ્રક્રિયા કરશે અને પછી તમને ઇલેક્ટ્રોનિક રીતે રસીદ પ્રદાન કરશે.

૪.૩ ચાર્જીસમાં ફેરફાર

માઈલ્સ ગો રાઈડ પોતાના વિવેકાધિકારે ચાર્જીસ નક્કી, સુધારી કે દૂર કરવાનો અધિકાર રાખે છે. માંગ, ભૂગોળીય સ્થાન અથવા અન્ય લાગુ પડતા પરિબળો આધારે ચાર્જીસ બદલાઈ શકે છે. માઈલ્સ ગો રાઈડ પોતાની પસંદગીથી કેટલાક યુઝર્સને પ્રમોશનલ ઓફર્સ કે ડિસ્કાઉન્ટ્સ આપી શકે છે. આ ઓફર્સ તમારા ચાર્જીસ પર લાગુ નહીં થાય સિવાય કે તે સ્પષ્ટ રીતે તમારા માટે ઉપલબ્ધ કરવામાં આવ્યા હોય.
માઈલ્સ ગો રાઈડ દ્વારા આપવામાં આવેલા વૉલેટ ફંડ્સ, વાઉચર્સ કે ડિસ્કાઉન્ટ્સ માત્ર એડવાન્સ બુકિંગ રકમ સામે લાગુ પડશે, કુલ ટ્રિપ પ્રાઈસ સામે નહીં. માઈલ્સ ગો રાઈડ કોઈપણ સમયે આવા લાભોને પાછા ખેંચવાનો અથવા રદ કરવાનો અધિકાર રાખે છે. ઓર્ડર કન્ફર્મેશન અને/અથવા એડવાન્સ પેમેન્ટ પહેલા બુકિંગ રદ કરવાથી એડવાન્સ અને/અથવા કેન્સલેશન ફી જપ્ત થઈ શકે છે.

૪.૪ ગ્રેચ્યુઈટીસ (ટિપ્સ)

માઈલ્સ ગો રાઈડ કોઈપણ ચુકવણીનો ભાગ અમારા ડ્રાઈવર પાર્ટનર્સ/તૃતીય પક્ષ પ્રદાતાઓ માટે ટિપ અથવા ગ્રેચ્યુઈટી તરીકે નિર્ધારિત નથી કરે. તમે તમારી ઈચ્છાથી ટિપ આપી શકો છો, પરંતુ તે સંપૂર્ણપણે વૈકલ્પિક છે અને ફરજિયાત નથી.

૪.૫ અનધિકૃત પેમેન્ટ

તમે પ્લેટફોર્મ બહાર અમારા ડ્રાઈવર પાર્ટનર્સ/તૃતીય પક્ષ પ્રદાતાઓને સીધી ચુકવણી (સફર પહેલા અથવા દરમ્યાન) ન કરો. માઈલ્સ ગો રાઈડ એપ્લિકેશનમાં જણાવેલ ભાડા કરતાં વધારાના સીધા ડ્રાઈવર્સને કરેલા પેમેન્ટ માટે જવાબદાર નથી.

૪.૬ વધારાના ચાર્જીસ (ટેક્સ, ટોલ, પાર્કિંગ)

સફર દરમિયાન થતા કોઈપણ ટોલ, ઇન્ટર-સ્ટેટ ટેક્સ, પાર્કિંગ ચાર્જીસ કે અન્ય ફી ચૂકવવાની જવાબદારી તમારી છે, સિવાય કે તે ટ્રિપ પેકેજમાં સામેલ હોય. આવા ચાર્જીસની રસીદો સીધા તૃતીય પક્ષ પ્રદાતા/ડ્રાઈવર પાર્ટનર પાસેથી મેળવવી જરૂરી છે. માઈલ્સ ગો રાઈડ આવી ચુકવણીઓ માટે ઇન્વૉઈસ પ્રદાન કરવા માટે જવાબદાર નથી.

૪.૭ ટૂંકી થયેલી ટ્રિપ્સ

જો તમે તમારી ટ્રિપ ટૂંકાવો (જેમ કે વહેલી પરતફેર, ન વપરાયેલા કિલોમીટર્સ અથવા ઓછી મુસાફરી સમય), તો પણ તમે સંપૂર્ણ ટ્રિપ પેકેજ કિંમત ચૂકવવા જવાબદાર રહેશો. આવી પરિસ્થિતિમાં કોઈ રિફંડ, કેશબેક અથવા વાઉચર્સ આપવામાં નહીં આવે.

૪.૮ લંબાયેલી ટ્રિપ્સ

જો તમારી રાઉન્ડ ટ્રિપ નિર્ધારિત પરત તારીખ અને સમય કરતાં આગળ વધે:

• રાત્રે ૧૨:૦૦ વાગ્યાથી ૩:૦૦ વાગ્યા વચ્ચે પ્રતિ કલાક INR ૨૫૦ વધારાનો ચાર્જ લાગશે.
• ટ્રિપ ૩:૦૦ વાગ્યા પછી લંબાય તો સંપૂર્ણ એક દિવસનો વધારાનો ચાર્જ લાગશે (૨૫૦ કિ.મી. × લાગુ પડતા પ્રતિ કિ.મી. ભાડા મુજબ ગણવામાં આવશે).

૪.૯ એડ–ઑન સેવાઓ

• એડ-ઑન સેવાઓના ચાર્જીસ (જેમ કે “અપગ્રેડ ટુ રિફંડેબલ બુકિંગ”) કોઈપણ પરિસ્થિતિમાં નોન-રિફંડેબલ રહેશે.
• જો એડ-ઑન સેવા પૂરી પાડવામાં ન આવે, તો ફક્ત તે એડ-ઑન માટેનો ચાર્જ જ રિફંડ કરવામાં આવશે. ટ્રિપ ભાડું અથવા અન્ય અસંબંધિત ચાર્જીસ રિફંડ નહીં થાય.

૪.૧૦ રીપેર અથવા ક્લીનિંગ ફી

તમારા પગલાંથી (સામાન્ય વેર એન્ડ ટીયરથી વધારે) વાહનને થયેલા નુકસાન કે સફાઈ ખર્ચ માટે તમે જવાબદાર રહેશો. તૃતીય પક્ષ પ્રદાતા દ્વારા નોંધાયેલ અને ચકાસાયેલ ક્લેમ્સ તમારા એકાઉન્ટમાં ચાર્જ થઈ શકે છે અને તે નોન-રિફંડેબલ રહેશે.
જો તમે પાળતુ પ્રાણીઓ સાથે મુસાફરી કરો છો, તો વધારાના ક્લીનિંગ ચાર્જીસ લાગશે:

• INR ૮૦૦ હેચબેક/સેડાન માટે
• INR ૧૦૦૦ SUV/ઇનોવા માટે
• INR ૨૦૦૦ ટેમ્પો ટ્રાવેલર કે મોટા વાહન માટે

૪.૧૧ સેલ્સ પાર્ટનર કમિશન

• માઈલ્સ ગો રાઈડ કોઈપણ સમયે કમિશન ટકા સુધારવાનો અધિકાર રાખે છે.
• ફક્ત પૂર્ણ થયેલી ટ્રિપ્સ કમિશન ચુકવણી માટે પાત્ર ગણાશે. રદ કરેલી ટ્રિપ્સમાં કમિશન પાછું ખેંચી લેવાઈ શકે છે.
• ન્યૂનતમ વિથડ્રૉ થ્રેશોલ્ડ: INR ૨૦૦૦. આ થ્રેશોલ્ડ સુધી પહોંચ્યા પછી જ કમિશન ચૂકવાશે.
• કમિશન પેમેન્ટ માટે PAN કાર્ડની વિગતો ફરજિયાત છે, અને PAN કાર્ડ上的 નામ બેંક એકાઉન્ટ ધારકના નામ સાથે મેળ ખાતું હોવું જોઈએ.

5. અસ્વીકરણ; જવાબદારીની મર્યાદા; ક્ષતિપૂર્તિ

5.1 અસ્વીકરણ
5.1.1 સેવાઓ “જેવું છે” અને “ઉપલબ્ધ છે” તેના આધારે પૂરી પાડવામાં આવે છે. MILES GO RIDE સ્પષ્ટ રીતે આ શરતોમાં દર્શાવેલ સિવાયની તમામ રજૂઆતો અને વોરંટી (વ્યક્ત, અનુમાનિત, અથવા કાનૂની)નું અસ્વીકાર કરે છે, જેમાં વેપારયોગ્યતા, ચોક્કસ હેતુ માટે યોગ્યતા અને બૌદ્ધિક સંપત્તિ ભંગ ન કરવા અંગેની અનુમાનિત વોરંટીનો સમાવેશ થાય છે.
5.1.2 MILES GO RIDE સેવાઓની વિશ્વસનીયતા, સમયસરતા, ગુણવત્તા, યોગ્યતા અથવા ઉપલબ્ધતા અંગે કોઈ રજૂઆત, વોરંટી અથવા ગેરંટી આપતું નથી, કે સેવાઓ અવિરત અથવા ભૂલમુક્ત રહેશે.
5.1.3 MILES GO RIDE તૃતીય-પક્ષ પ્રદાતાઓની ગુણવત્તા, યોગ્યતા, સલામતી અથવા ક્ષમતા અંગે ગેરંટી આપતું નથી. તમે સહમત છો કે સેવાઓના તમારા ઉપયોગથી અને તેના સંબંધિત કોઈપણ સેવા અથવા માલમાંથી ઉદ્ભવતા તમામ જોખમ તમારું જ રહેશે, કાયદા હેઠળ પરવાનગી આપેલ મહત્તમ હદ સુધી.

5.2 જવાબદારીની મર્યાદા
5.2.1 MILES GO RIDE કોઈપણ પ્રકારના સીધા, પરોક્ષ, આકસ્મિક, ખાસ, ઉદાહરણરૂપ, દંડાત્મક અથવા અનુસંગિક નુકસાન માટે જવાબદાર નહીં રહે, જેમાં પરંતુ મર્યાદિત નહીં હોય: નફાનો નુકસાન, ડેટાનો નુકસાન, વ્યક્તિગત ઈજા અથવા સંપત્તિનું નુકસાન, જેની ઉત્પત્તિ કે સંબંધ નીચેની બાબતોમાંથી થાય છે:

• (i) સેવાઓનો તમારો ઍક્સેસ અથવા ઉપયોગ, અથવા તેનો ઉપયોગ કરવામાં અસમર્થતા;
• (ii) તમારું અને કોઈપણ તૃતીય-પક્ષ પ્રદાતા વચ્ચેનું વ્યવહાર અથવા સંબંધ;
• (iii) સેવાઓના પ્રદર્શન દરમિયાન કોઈપણ પ્રકારની વિલંબ, નિષ્ફળતા, ખલેલ અથવા ભૂલો; અથવા
• (iv) MILES GO RIDEના વાજબી નિયંત્રણની બહારની પરિસ્થિતિઓ.

5.2.2 કોઈપણ ઘટનામાં, સેવાઓ સાથે સંબંધિત તમામ નુકસાન, નુકસાની અને કાર્યવાહી માટે તમારી સામે MILES GO RIDEની કુલ જવાબદારી ₹500 (માત્ર પાંચસો રૂપિયા)થી વધુ નહીં હોય.

5.2.3 તમે સ્વીકારો છો કે તૃતીય-પક્ષ પ્રદાતાઓ વ્યાવસાયિક રીતે લાઇસન્સ ધરાવતા અથવા પરવાનગીપ્રાપ્ત ન હોઈ શકે. MILES GO RIDE નીચેની બાબતો અંગે જવાબદારીનો અસ્વીકાર કરે છે:

• (i) તૃતીય-પક્ષ પ્રદાતાઓ દ્વારા COVID-19 અથવા અન્ય સરકાર દ્વારા જાહેર કરેલ માર્ગદર્શિકાનું પાલન ન થવું;
• (ii) મુસાફરી માટે જરૂરી પાસ, પરવાનગી અથવા તબીબી ટેસ્ટ રિપોર્ટ (COVID-19 ટેસ્ટ રિપોર્ટ સહિત); આ બધું તમારે તમારા પોતાના ખર્ચે જ વ્યવસ્થિત કરવું પડશે.

5.2.4 તમારે ખાતરી કરવી પડશે કે સોંપવામાં આવેલ વાહન અને ડ્રાઇવર MILES GO RIDE દ્વારા પ્રદાન કરેલ ઓળખ વિગતો (લાઇસન્સ, ડ્રાઇવરનું નામ, વાહન નંબર) સાથે મેળ ખાતા હોય. જો તમે એવા ડ્રાઇવર અથવા વાહન સાથે મુસાફરી કરો છો જે MILES GO RIDE દ્વારા ચકાસાયેલ નથી, તો તેના તમામ પરિણામો માટે તમે જ સંપૂર્ણ જવાબદાર હશો, જેમાં ઓછામાં ઓછું ₹10,000 (માત્ર દસ હજાર રૂપિયા) MILES GO RIDEને ચૂકવવાના નુકસાનનો સમાવેશ થાય છે. આવી સ્થિતિમાં કોઈ રિફંડ આપવામાં આવશે નહીં અને વિવાદો તમારે સીધા તૃતીય-પક્ષ પ્રદાતા સાથે ઉકેલવા પડશે.

5.2.5 MILES GO RIDE ટ્રેન, ફ્લાઇટ, ઇવેન્ટ ચૂકી જવા અથવા તેના નિયંત્રણની બહારના પરિબળો (પ્રાકૃતિક આફતો, ટ્રાફિક, અકસ્માત, હડતાલો અથવા સરકારી પ્રતિબંધો સહિત)થી થતા કોઈપણ વિલંબ માટે જવાબદાર નહીં રહે. આવી સ્થિતિમાં, માનક રદ અને રિફંડ નીતિ લાગુ પડશે.

5.2.6 તૃતીય-પક્ષ પ્રદાતા અથવા ડ્રાઇવર તમને તમારી નિર્ધારિત સવારી પહેલા યોગ્ય સમયે સોંપી શકાય છે.

5.2.7 જો વાહનમાં 30 મિનિટથી વધુ વિલંબ થાય (અને પિકઅપ વિગતો યોગ્ય રીતે આપવામાં આવી હોય), તો MILES GO RIDE માત્ર તમને સોંપાયેલા ડ્રાઇવર અથવા તૃતીય-પક્ષ પ્રદાતા સાથે સંપર્ક કરવામાં મદદ કરશે. એડવાન્સ બુકિંગ રકમની કોઈ રિફંડ આપવામાં આવશે નહીં.

5.2.8 ફરિયાદો નિર્ધારિત સવારી પૂર્ણ થયા પછી 3 વ્યવસાય દિવસોમાં જ ઉઠાવવી પડશે. તે પછી કરાયેલી ફરિયાદો સ્વીકારવામાં આવશે નહીં.

5.2.9 MILES GO RIDE કોઈપણ સમયે પોતાની ઇચ્છાથી કોઈપણ બુકિંગ રદ કરવાનો અધિકાર રાખે છે.

5.2.10 સાઇટ અથવા એપ્લિકેશન પર ટેકનિકલ ભૂલો, નેટવર્ક સમસ્યાઓ, મેલવેર, ખોટા સંપર્ક નંબર અથવા અધૂરા/ખોટી માહિતીના કારણે થયેલા નુકસાન માટે MILES GO RIDE જવાબદાર નહીં રહે.

5.2.11 સામાન મર્યાદા: સેડાનમાં મહત્તમ 2 બેગ અને મોટા વાહનોમાં (જેમ કે SUV, Innova) 4 બેગ. દરેક બેગનું સંયુક્ત પરિમાણ 158 સે.મી. (62.2 ઈંચ) અને વજન 32 કિગ્રા કરતા વધુ ન હોવું જોઈએ.

5.2.12 તમારા સામાન માટે તમે જ સંપૂર્ણ જવાબદાર છો. MILES GO RIDE ગુમ થયેલ વસ્તુઓ શોધવામાં “શ્રેષ્ઠ પ્રયાસ” કરશે, પરંતુ તેની પુનઃપ્રાપ્તિ અથવા સ્થિતિ માટે કોઈ જવાબદારી લેતું નથી. ગુમ થયેલ વસ્તુઓ 3 કામકાજના દિવસો પછી નિર્ધારિત ઓફિસમાંથી મેળવી શકાય છે અથવા જો ઓફિસથી 20 કિમીની અંદર ડિલિવરી માંગવામાં આવે, તો રૂ. 500 – રૂ. 1000 (માત્ર પાંચસો થી એક હજાર રૂપિયા) સ્થિર ફી લેવામાં આવશે.

5.2.13 MILES GO RIDE સેવાઓની અવિરત ઉપલબ્ધતાની કોઈ ગેરંટી આપતું નથી.

5.2.14 બધી માહિતી, જેમાં બુકિંગ પુષ્ટિ, સ્થિતિ અપડેટ્સ અને પ્રોગ્રામ લાભોનો સમાવેશ થાય છે, તમારી નોંધાયેલ મોબાઇલ નંબર અને/અથવા ઇમેલ પર મોકલવામાં આવશે. તમારી દ્વારા આપેલ ખોટી અથવા અપ્રવર્તમાન સંપર્ક વિગતોના કારણે થતી સંચાર નિષ્ફળતાઓ માટે MILES GO RIDE જવાબદાર નહીં રહે.

5.3 ક્ષતિપૂર્તિ
5.3.1 તમે સહમત છો કે તમે MILES GO RIDE, તેની સહાયકારી કંપનીઓ, અધિકારીઓ, નિર્દેશકો, કર્મચારીઓ અને એજન્ટોને કોઈપણ દાવા, માંગણીઓ, નુકસાની, જવાબદારીઓ અથવા ખર્ચ (વકીલ ફી સહિત)થી ક્ષતિપૂર્તિ આપશો, તેમનો બચાવ કરશો અને નિર્દોષ રાખશો, જેની ઉત્પત્તિ કે સંબંધ નીચેની બાબતોમાંથી થાય છે:

• (i) સેવાઓનો તમારો ઉપયોગ અથવા સેવાઓ દ્વારા પ્રાપ્ત કોઈપણ માલ;
• (ii) આ શરતોનો તમારો ભંગ;
• (iii) MILES GO RIDE દ્વારા તમારા દ્વારા સબમિટ કરેલ યુઝર કન્ટેન્ટનો ઉપયોગ; અથવા
• (iv) કોઈપણ તૃતીય પક્ષ, જેમાં તૃતીય-પક્ષ પ્રદાતાઓનો સમાવેશ થાય છે,ના અધિકારોનો તમારો ભંગ.

6. શાસન કાયદો; મધ્યસ્થી (Arbitration)

6.1 આ નિયમો ભારતના કાયદાઓ અનુસાર શાસિત અને તેની જોગવાઈઓ પ્રમાણે વ્યાખ્યાયિત કરવામાં આવશે.

6.2 આ નિયમો, તેમના ભંગ, સમાપ્તિ, અમલ, વ્યાખ્યા, અથવા માન્યતા, અથવા સાઇટ, એપ્લિકેશન, અથવા સેવાઓના ઉપયોગ (એક સાથે “વિવાદો” તરીકે ઓળખાય છે) સંબંધિત કોઈપણ વિવાદ, દાવો, અથવા વિવાદાસ્પદ મુદ્દો સૌપ્રથમ મૈત્રીપૂર્ણ રીતે ચર્ચા અને પરામર્શ દ્વારા ઉકેલવાનો પ્રયાસ કરવામાં આવશે, MILES GO RIDE દ્વારા નક્કી કરાયેલ ઓફિસ સ્થળે.

6.3 જો 30 (ત્રીસ) દિવસની સદભાવનાપૂર્વકની ચર્ચા દરમિયાન વિવાદ ઉકેલાઈ ન શકે, તો એવો વિવાદ મધ્યસ્થીમાં રિફર કરવામાં આવશે અને મધ્યસ્થી અને સમાધાન અધિનિયમ, 1996 (સમયાંતરે કરવામાં આવેલા સુધારો સાથે)ની જોગવાઈઓ અનુસાર અંતિમ રીતે ઉકેલવામાં આવશે. જો તે અધિનિયમ અમલમાં ન હોય, તો તે સમયે ભારતમાં અમલમાં રહેલા લાગુ પડતા મધ્યસ્થી કાયદાના આધારે વિવાદ ઉકેલવામાં આવશે.

6.4 મધ્યસ્થી કાર્યવાહી નીચે મુજબ કરવામાં આવશે:

• દરેક પક્ષ એક મધ્યસ્થી નિમશે અને નિમાયેલા બે મધ્યસ્થીઓ સંયુક્ત રીતે ત્રીજા/પ્રમુખ મધ્યસ્થીને નિમશે.
• મધ્યસ્થીનું સ્થળ અને કેન્દ્ર અમદાવાદ, ગુજરાત, ભારત રહેશે.
• મધ્યસ્થી અંગ્રેજી/હિન્દી/ગુજરાતી ભાષામાં કરવામાં આવશે.

6.5 ઉપરોક્ત મધ્યસ્થી કલમને આધીન રહીને, અમદાવાદ, ગુજરાત, ભારતના અદાલતોને આ નિયમો હેઠળ અથવા તેના સંબંધમાં ઊભા થતા તમામ મુદ્દાઓ પર વિશિષ્ટ અધિકારક્ષેત્ર (exclusive jurisdiction) મળશે.

7. અન્ય જોગવાઈઓ

7.1 કૉપિરાઇટ ઉલ્લંઘન સંબંધિત દાવા
7.1.1 સેવાઓ સંબંધિત કોઈપણ કૉપિરાઇટ ઉલ્લંઘનના દાવા MILES GO RIDE ને સંબોધવા જોઈએ. કૃપા કરીને નિર્ધારિત સરનામું અને વધારાની માહિતી માટે www.milesgoride.com નો સંદર્ભ લો.

7.2 સૂચનાઓ (Notices)
7.2.1 MILES GO RIDE નીચેના કોઈપણ માધ્યમ દ્વારા સૂચનાઓ આપી શકે છે:

• સેવાઓ પર સામાન્ય સૂચના પોસ્ટ કરીને,
• તમારા ખાતામાં નોંધાયેલ ઇમેલ સરનામે ઇમેલ મોકલીને,
• તમારા ખાતામાં નોંધાયેલ મોબાઇલ નંબર પર SMS મોકલીને, અથવા
• તમારા ખાતામાં આપેલા સરનામે લેખિત સંદેશાવ્યવહાર કરીને.

7.2.2 તમે MILES GO RIDE ને નીચે આપેલ ઇમેલ દ્વારા સૂચનાઓ મોકલી શકો છો – support@milesgoride.com

7.3 સામાન્ય
7.3.1 તમે MILES GO RIDE ની પૂર્વ લેખિત મંજૂરી વિના આ નિયમો, સંપૂર્ણ અથવા ભાગમાં, સોંપી (assign) અથવા ટ્રાન્સફર કરી શકતા નથી.

7.3.2 MILES GO RIDE આ નિયમો, સંપૂર્ણ અથવા ભાગમાં, કોઈપણ પ્રતિબંધ વિના સોંપી (assign) અથવા ટ્રાન્સફર કરી શકે છે, જેમાં સામેલ છે (પરંતુ મર્યાદિત નથી):
(i) કોઈ પેટાકંપની અથવા સહભાગી સંસ્થા,
(ii) MILES GO RIDE ની ઇક્વિટી, વ્યવસાય, અથવા સંપત્તિ ખરીદનાર, અથવા
(iii) વિલીન (merger) મુજબ ઉત્તરાધિકારી સંસ્થા.

7.3.3 આ નિયમો અથવા સેવાઓના તમારા ઉપયોગના પરિણામે, તમારા અને MILES GO RIDE અથવા કોઈપણ તૃતીય-પક્ષ પ્રદાતાઓ વચ્ચે કોઈ સંયુક્ત સાહસ, ભાગીદારી, રોજગાર, અથવા એજન્સી સંબંધ અસ્તિત્વમાં નથી.

અન્ય નિયમો અને શરતો

• વાહનમાં મુસાફરી ન કરો જો તે પાસે માન્ય કોમર્શિયલ લાયસન્સ ન હોય.
• મુસાફરી ન કરો જો વાહન અને ડ્રાઇવર સંબંધિત વિગતો આપને આપવામાં આવેલી વિગતો સાથે મેળ ખાતી ન હોય.
• જો તમે કોમર્શિયલ લાયસન્સ વિના વાહનમાં અથવા તમને સોંપાયેલા ડ્રાઇવર સિવાય બીજા ડ્રાઇવર સાથે મુસાફરી કરવાનું પસંદ કરો છો, તો Miles Go Ride કોઈ રીતે જવાબદાર કે જવાબદેહ નહીં હોય.
• એકવાર તમે મુસાફરીની શરૂઆતમાં ટેક્સી અને ડ્રાઇવરનું વેરીફિકેશન પૂર્ણ કરી લો, ત્યારબાદ Miles Go Ride ફક્ત અમારા સોંપાયેલા ડ્રાઇવર માટે જ જવાબદાર રહેશે. ગ્રાહકને ડ્રાઇવર સાથે મૅચ કર્યા પછી મુસાફરી દરમિયાન બનતી કોઈપણ ઘટનાની જવાબદારી Miles Go Ride ની રહેશે નહીં.

ડ્રાઇવર ચકાસણી (Driver Verification)

મુસાફરી શરૂ કરવા પહેલાં, ડ્રાઇવર તમારી ઓળખ (જેમ કે આધાર કાર્ડ, પાન કાર્ડ) જોવા વિનંતી કરી શકે છે.

દિવસની વ્યાખ્યા (Definition of a Day)

એક દિવસનો અર્થ છે સંપૂર્ણ કેલેન્ડર દિવસ (રાત્રીના 12:00 વાગ્યાથી લઈને બીજા દિવસની રાત્રીના 12:00 વાગ્યા સુધી).

અંતર ગણતરી (Distance Calculation)

અંતર ગૂગલ મેપ્સ દ્વારા ચોક્કસ મુસાફરીના માર્ગ અને સ્થાનના આધારે માપવામાં આવશે. જો મુસાફરી કરાયેલ કિલોમીટર્સ બુક કરાયેલા કિલોમીટર્સથી વધુ થશે, તો વધારાના કિલોમીટર્સ માટે પ્રમાણભૂત માપદંડ મુજબ વધારાનો ચાર્જ લેવામાં આવશે.

ટોલ, રાજ્ય કર, અને પાર્કિંગ (Toll, State Tax, and Parking)

બધા ટોલ ટેક્સ, રાજ્ય (બોર્ડર) ટેક્સ અને પાર્કિંગ ફી ગ્રાહક દ્વારા વાસ્તવિક મુજબ ચૂકવવાના રહેશે. આ બુકિંગ રકમમાં સામેલ નથી. એરપોર્ટ પ્રવેશ ફી, પાર્કિંગ અથવા પ્રવેશ ફી પણ ગ્રાહકની જ જવાબદારી રહેશે.

સામાન અને મુસાફરો (Luggage and Passengers)

વાહન કેટેગરીમાં દર્શાવેલા કરતા વધારાના મુસાફરો અથવા વધારાનું સામાન મંજૂર નથી.

વાહન મોડલની ખાતરી (Vehicle Model Guarantees)

Miles Go Ride સાથે બુકિંગ કર્યા પછી, અમે ફક્ત વાહન કેટેગરીની ખાતરી આપી શકીએ છીએ, ચોક્કસ મોડલની નહીં. તમારી મુસાફરી માટે કોઈ ચોક્કસ મોડલની ઉપલબ્ધતા અમે ખાતરીપૂર્વક આપી શકતા નથી. જો ચોક્કસ મોડલ ઉપલબ્ધ ન હોય તો કોઈ રિફંડ આપવામાં આવશે નહીં.

ડ્રાઇવર ભોજન (Driver Meals)

મુસાફરી દરમિયાન ડ્રાઇવર પોતાનું ભોજન સ્વયં જ વ્યવસ્થા કરશે.

ગ્રાહક વર્તન (Customer Conduct)

ભાડા ગણતરી (Fare Calculations)

વન-વે અથવા રાઉન્ડ-ટ્રિપ ભાડું વિવિધ નિયમો પર આધારિત છે અને કેટલાક રાજ્યો અથવા પર્યટન સ્થળો માટે અલગ હોઈ શકે છે. વધારાના પિકઅપ અથવા ડ્રોપ-ઑફ પોઇન્ટ માટે વધારાનો ચાર્જ લાગશે.

વધારાના ચાર્જિસ (Additional Charges)

મુસાફરી દરમિયાન બુકિંગમાં સામેલ ન થયેલા બધા વધારાના ખર્ચો અને ફી ગ્રાહકની જ જવાબદારી રહેશે.

1. संविदात्मक संबंध (Contractual Relationship)

1.1 लागूता (Applicability)
ये उपयोग की शर्तें (“शर्तें”) आपके द्वारा माइल्स गो राइड, इंडिया द्वारा उपलब्ध कराए गए एप्लिकेशन, वेबसाइट, सामग्री, उत्पाद और सेवाओं (सामूहिक रूप से “सेवाएँ”) की पहुँच और उपयोग को नियंत्रित करती हैं, चाहे आप किसी भी देश से इनका उपयोग करें।

1.2 शर्तों की स्वीकृति (Acceptance of Terms)

• सेवाओं का उपयोग या उन तक पहुँच प्राप्त करके, आप स्वीकार करते हैं और सहमत होते हैं कि आप इन शर्तों से कानूनी रूप से बंधे हुए हैं। यह आपके और माइल्स गो राइड के बीच एक संविदात्मक संबंध स्थापित करता है।
• यदि आप इन शर्तों से सहमत नहीं हैं, तो आपको सेवाओं तक पहुँच या उपयोग नहीं करना चाहिए।
• ये शर्तें आपके और माइल्स गो राइड के बीच किसी भी पूर्व समझौते या व्यवस्था को अधिलेखित (supersede) करती हैं।
• माइल्स गो राइड अपने एकमात्र विवेक पर, किसी भी समय, किसी भी कारण से, बिना पूर्व सूचना के इन शर्तों को समाप्त कर सकता है, सेवाओं को (पूरी या आंशिक रूप से) निलंबित या बंद कर सकता है, या आपकी सेवाओं तक पहुँच को सीमित कर सकता है।

1.3 पूरक शर्तें (Supplemental Terms)

• कुछ सेवाएँ विशेष नीतियों जैसे कि आयोजनों, गतिविधियों, या प्रमोशनों (“पूरक शर्तें”) के अधीन हो सकती हैं।
• पूरक शर्तें आपको संबंधित सेवा के साथ प्रकट की जाएंगी और इन्हें इन शर्तों का हिस्सा माना जाएगा।
• किसी भी टकराव की स्थिति में, लागू सेवा के संबंध में पूरक शर्तें प्रभावी होंगी।

1.4 सूचना साझा करना (Information Sharing)

• किसी शिकायत, विवाद, या संघर्ष (जिसमें दुर्घटनाएँ भी शामिल हैं) की स्थिति में, जिसमें आप और कोई तृतीय-पक्ष प्रदाता (जैसे परिवहन नेटवर्क कंपनी का ड्राइवर) शामिल हों, माइल्स गो राइड बीमा कंपनी, दावा संसाधक, या अन्य संबंधित पक्ष के साथ आपकी आवश्यक जानकारी (जिसमें संपर्क विवरण भी शामिल है) साझा कर सकता है।
• ऐसी जानकारी का साझा करना केवल उतनी सीमा तक होगा जितना विवाद या शिकायत के समाधान के लिए उचित रूप से आवश्यक हो।

2. सेवाएँ (The Services)

2.1 सेवाओं की प्रकृति (Nature of Services)
माइल्स गो राइड द्वारा प्रदान की गई सेवाएँ टैक्सी/कैब बुकिंग और परिवहन सुविधा मंच हैं। मोबाइल एप्लिकेशन, वेबसाइट, या निर्दिष्ट फोन नंबर (“एप्लिकेशन”) के माध्यम से, उपयोगकर्ता स्वतंत्र तृतीय-पक्ष परिवहन प्रदाताओं के साथ परिवहन सेवाएँ तय और अनुसूचित कर सकते हैं, जो माइल्स गो राइड या इसकी सहयोगी कंपनियों के साथ अनुबंध के अंतर्गत आते हैं।
जब तक किसी पृथक लिखित अनुबंध में अन्यथा सहमति न हो, सेवाएँ केवल व्यक्तिगत, गैर-व्यावसायिक उपयोग के लिए प्रदान की जाती हैं।

2.2 लाइसेंस (License)
2.2.1 लाइसेंस का अनुदान (Grant of License)
यदि आप लगातार इन शर्तों का पालन करते हैं, तो माइल्स गो राइड आपको एक सीमित, गैर-विशिष्ट, गैर-सब-लाइसेंस योग्य, रद्द करने योग्य और गैर-हस्तांतरणीय लाइसेंस प्रदान करता है, ताकि आप:

• अपने व्यक्तिगत उपकरण पर केवल सेवाओं के उपयोग के संबंध में एप्लिकेशन तक पहुँच और उपयोग कर सकें; और
• सेवाओं के माध्यम से उपलब्ध कराई गई किसी भी सामग्री, जानकारी, या संबंधित सामग्री तक पहुँच और उपयोग कर सकें, सख्ती से व्यक्तिगत और गैर-व्यावसायिक उपयोग के लिए।
  यहाँ पर स्पष्ट रूप से दिए गए अधिकारों को छोड़कर अन्य सभी अधिकार माइल्स गो राइड और उसके लाइसेंसधारकों के पास सुरक्षित हैं।

2.3 प्रतिबंध (Restrictions)
2.3.1 निषिद्ध उपयोग (Prohibited Uses)
आप सहमत हैं कि आप किसी भी परिस्थिति में:
i. सेवाओं के किसी भी हिस्से से कॉपीराइट, ट्रेडमार्क, या स्वामित्व संबंधी नोटिस को हटाएँ, परिवर्तित करें या छिपाएँ नहीं;
ii. सेवाओं की प्रतिलिपि बनाएँ, पुनरुत्पादित करें, संशोधित करें, व्युत्पन्न कार्य बनाएँ, वितरित करें, लाइसेंस दें, लीज़ पर दें, बेचें, पुनः बेचें, स्थानांतरित करें, सार्वजनिक रूप से प्रदर्शित करें, सार्वजनिक रूप से प्रस्तुत करें, प्रसारित करें, स्ट्रीम करें, प्रसारण करें या अन्यथा उपयोग करें, सिवाय जहाँ माइल्स गो राइड द्वारा स्पष्ट रूप से अनुमति दी गई हो;
iii. लागू कानून द्वारा अनुमति दिए जाने को छोड़कर सेवाओं का डी-कंपाइल, रिवर्स इंजीनियरिंग या डिसअसेंबल न करें;
iv. माइल्स गो राइड की पूर्व लिखित सहमति के बिना सेवाओं के किसी भी हिस्से को लिंक, मिरर, या फ्रेम न करें;
v. किसी भी स्वचालित प्रोग्राम, बॉट, स्क्रिप्ट, या उपकरण को लॉन्च या लॉन्च करवाकर डेटा स्क्रैपिंग, इंडेक्सिंग, सर्वेक्षण, या डेटा माइनिंग न करें, या सेवाओं के संचालन को बाधित न करें;
vi. सेवाओं, या किसी संबंधित प्रणाली या नेटवर्क तक अनधिकृत पहुँच प्राप्त करने, बाधित करने, या हस्तक्षेप करने का प्रयास न करें।

2.4 सेवाओं का प्रावधान (Provision of Services)
2.4.1 सेवा प्रदाता (Service Providers)
आप स्वीकार करते हैं कि सेवाएँ निम्नलिखित द्वारा उपलब्ध कराई जा सकती हैं:
i. माइल्स गो राइड की कुछ सहायक या संबद्ध कंपनियाँ; और/या
ii. स्वतंत्र तृतीय-पक्ष प्रदाता, जिनमें लाइसेंस प्राप्त परिवहन नेटवर्क ड्राइवर, परिवहन चार्टर परमिट धारक, या समान परिवहन प्राधिकरण और अनुमति धारक शामिल हो सकते हैं।

2.5 तृतीय–पक्ष सेवाएँ और सामग्री (Third-Party Services and Content)
2.5.1 बाहरी सेवाएँ (External Services)
सेवाएँ तृतीय-पक्ष सेवाओं या सामग्री (जैसे विज्ञापन) के साथ एकीकृत हो सकती हैं या उनसे जुड़ी हो सकती हैं, जो माइल्स गो राइड द्वारा नियंत्रित नहीं होतीं। आप स्वीकार करते हैं कि:

• ऐसी तृतीय-पक्ष सेवाओं और सामग्री के उपयोग पर विभिन्न शर्तें और गोपनीयता नीतियाँ लागू हो सकती हैं;
• माइल्स गो राइड ऐसी तृतीय-पक्षों द्वारा उपलब्ध कराए गए किसी भी उत्पाद, सेवा, या सामग्री का समर्थन नहीं करता और उसके लिए जिम्मेदार या उत्तरदायी नहीं होगा।

2.6 स्वामित्व (Ownership)
2.6.1 बौद्धिक संपदा अधिकार (Intellectual Property Rights)
सेवाएँ और उनमें निहित सभी अधिकार माइल्स गो राइड या उसके लाइसेंसधारकों की एकमात्र संपत्ति बने रहेंगे। इन शर्तों में आपको यह अधिकार नहीं दिया गया है:
i. सेवाओं से संबंधित स्वामित्व अधिकार या हित, सिवाय उस सीमित लाइसेंस के जो धारा 2.2 के अंतर्गत स्पष्ट रूप से प्रदान किया गया है; या
ii. किसी भी प्रकार से माइल्स गो राइड या उसके लाइसेंसधारकों के कंपनी नाम, लोगो, उत्पाद या सेवा नाम, ट्रेडमार्क, या सेवा चिह्नों का उपयोग, संदर्भ या शोषण करने का कोई अधिकार।

3. सेवाओं का आपका उपयोग

3.1 उपयोगकर्ता खाते

3.1.1 सेवाओं की अधिकांश विशेषताओं तक पहुँचने और उनका उपयोग करने के लिए, आपको एक सक्रिय व्यक्तिगत सेवा खाता (“खाता”) पंजीकृत करना और बनाए रखना होगा। खाता बनाने के लिए आपकी आयु कम से कम 18 वर्ष होनी चाहिए। पंजीकरण के दौरान, आपको MILES GO RIDE को कुछ व्यक्तिगत जानकारी प्रदान करनी होगी, जिसमें आपका नाम, पता, मोबाइल नंबर और ईमेल पता शामिल (लेकिन सीमित नहीं) है।

आप सहमत हैं कि आप अपने खाते की जानकारी हमेशा सटीक, पूर्ण और अद्यतन रखेंगे। ऐसा न करने पर सेवाओं तक पहुँचने में असमर्थता या खाते की समाप्ति हो सकती है।

आप अपने खाते के अंतर्गत की जाने वाली सभी गतिविधियों के लिए स्वयं जिम्मेदार हैं और ऐसी गतिविधियों से उत्पन्न किसी भी दावे, क्षति या देयता के लिए MILES GO RIDE को हानि-रहित और सुरक्षित रखने पर सहमत हैं। आप अपने खाते की साख (क्रेडेंशियल्स) की गोपनीयता बनाए रखने और किसी तीसरे पक्ष के साथ पासवर्ड साझा न करने पर सहमत हैं। जब तक MILES GO RIDE लिखित रूप से अनुमति न दे, आप केवल एक (1) खाता ही रख सकते हैं।

3.1.2 आप बिक्री भागीदार (जैसे एफिलिएट पार्टनर, ट्रैवल एजेंट पार्टनर, या API पार्टनर) के रूप में भी पंजीकरण कर सकते हैं। एक बिक्री भागीदार के रूप में, आप अपने चैनलों के माध्यम से MILES GO RIDE के लिए व्यवसाय उत्पन्न करेंगे और बदले में बिक्री कमीशन प्राप्त करेंगे, जो लागू भागीदार नीतियों के अधीन होगा। ये शर्तें बिक्री भागीदारों और ऐसे भागीदारों के माध्यम से सेवाएँ लेने वाले अंतिम उपयोगकर्ताओं पर समान रूप से लागू होंगी।

3.2 उपयोगकर्ता आवश्यकताएँ और आचरण

3.2.1 सेवाएँ 18 वर्ष से कम आयु के व्यक्तियों के लिए उपलब्ध नहीं हैं। आप किसी तीसरे पक्ष को अपने खाते का उपयोग करने की अनुमति नहीं दे सकते। 18 वर्ष से कम आयु के व्यक्ति केवल तभी परिवहन सेवाओं का उपयोग कर सकते हैं जब वे आपके साथ हों। आप अपना खाता किसी अन्य व्यक्ति को स्थानांतरित, सौंप या साझा नहीं कर सकते।

आप सभी लागू कानूनों का पालन करेंगे और सेवाओं का उपयोग केवल वैध उद्देश्यों के लिए करेंगे (जैसे अवैध, प्रतिबंधित या खतरनाक सामग्री का परिवहन नहीं करना)।

• सेवाएँ केवल बुक किए गए गंतव्यों तक ही मान्य हैं और उन्हें अतिरिक्त या वैकल्पिक बिंदुओं पर मोड़ा नहीं जा सकता, भले ही पैकेज में शामिल कुल दूरी पूरी तरह उपयोग न हुई हो।
• बाहरी (आउटस्टेशन) यात्राओं के लिए, पिकअप स्थान पर स्थानीय शहर यात्रा शामिल नहीं है, जब तक कि यात्रा कार्यक्रम में स्पष्ट रूप से शामिल न हो।
• यदि आप यात्रा को समय से पहले समाप्त करते हैं, तो कोई धनवापसी, समायोजन या आंशिक मुआवजा प्रदान नहीं किया जाएगा।
• एकतरफा यात्राओं के लिए केवल एक पिकअप और एक ड्रॉप शामिल है; अतिरिक्त पिकअप, ड्रॉप या रुकने के लिए अतिरिक्त शुल्क लिया जा सकता है।
• पहाड़ी क्षेत्रों या जहाँ परिचालन रूप से आवश्यक हो, एयर-कंडीशनिंग (AC) बंद रहेगी।
• आपको सेवाओं का उपयोग करते समय कोई उपद्रव, असुविधा, संपत्ति को नुकसान या कदाचार नहीं करना चाहिए।
• शराब, नशीले पदार्थों और धूम्रपान का सेवन सख्त वर्जित है।

3.2.2 आप विशेष वाहन ब्रांड, ईंधन प्रकार, पंजीकरण नंबर या ऐसी विशेषताएँ जिनका बुकिंग के समय वादा नहीं किया गया है, की मांग नहीं कर सकते।

• सेडान बुकिंग के लिए कोई भी 4+1 सीट वाली कार प्रदान की जा सकती है; SUV बुकिंग के लिए कोई भी 6+1 सीट वाली कार दी जा सकती है।
• टेम्पो ट्रैवलर बुकिंग में AC की गारंटी नहीं है।
• सामान की अनुमति प्रचलित सुरक्षा मानकों के अधीन होगी।
• सेवाओं का उपयोग करने से पहले आपको मान्य पहचान प्रमाण प्रस्तुत करने की आवश्यकता हो सकती है; मना करने पर बिना धनवापसी के सेवा से इनकार किया जा सकता है।

3.2.3 MILES GO RIDE चालक, तृतीय-पक्ष प्रदाताओं या ग्राहकों के बीच धर्म, जाति, लिंग या आयु के आधार पर कोई भेदभाव नहीं करता। ऐसी आधार पर की गई कोई भी रद्दीकरण, संशोधन या धनवापसी अनुरोध अस्वीकृत कर दिए जाएँगे और कोई भी अग्रिम भुगतान जब्त कर लिया जाएगा।

3.2.4 तृतीय-पक्ष के आचरण के कारण धनवापसी, रद्दीकरण या मुआवजे का दावा स्वीकार नहीं किया जाएगा जब तक कि वह गंभीर दुराचार (जैसे यौन उत्पीड़न) न हो। ऐसे मामलों की जाँच और मूल्यांकन MILES GO RIDE अपने विवेक से केस-टू-केस आधार पर करेगा। जबकि कंपनी एक गरिमापूर्ण और परेशानी-मुक्त यात्रा अनुभव सुनिश्चित करने का प्रयास करती है, यह कानूनी दायित्वों से परे तृतीय-पक्ष व्यवहार के लिए कोई जिम्मेदारी स्वीकार नहीं करती।

3.3 टेक्स्ट संदेश

3.3.1 खाता बनाने या सक्रिय करने पर, आप MILES GO RIDE से सामान्य व्यावसायिक संचालन के हिस्से के रूप में लेन-देन संबंधी और परिचालन SMS/टेक्स्ट संदेश प्राप्त करने की सहमति देते हैं।

3.4 प्रोमोशनल कोड

3.4.1 MILES GO RIDE अपने विवेकानुसार प्रोमोशनल कोड (“प्रोमो कोड”) जारी कर सकता है, जिन्हें खाता क्रेडिट, छूट या अन्य लाभों के लिए भुनाया जा सकता है। प्रोमो कोड उन अतिरिक्त शर्तों के अधीन होंगे जो जारी करते समय बताई जाएँगी और:

• केवल अपने निर्धारित उद्देश्य और दर्शकों के लिए उपयोग किए जा सकते हैं;
• बिना अनुमति बेचे, स्थानांतरित, नकल या सार्वजनिक नहीं किए जा सकते;
• किसी भी समय बिना दायित्व के रद्द, निष्क्रिय या संशोधित किए जा सकते हैं;
• नकद के लिए भुनाए नहीं जा सकते;
• उपयोग से पहले समाप्त हो सकते हैं;
• दुरुपयोग, धोखाधड़ी या त्रुटि के मामलों में रोके या समायोजित किए जा सकते हैं।

3.5 उपयोगकर्ता–प्रदत्त सामग्री

3.5.1 आप सेवाओं के माध्यम से पाठ, चित्र, ऑडियो, वीडियो या प्रतिक्रिया (“उपयोगकर्ता सामग्री”) प्रस्तुत या अपलोड कर सकते हैं। उपयोगकर्ता सामग्री प्रदान करके, आप MILES GO RIDE को एक विश्वव्यापी, स्थायी, अपरिवर्तनीय, रॉयल्टी-फ्री, हस्तांतरणीय लाइसेंस (सबसंविदा अधिकारों सहित) प्रदान करते हैं ताकि वह इस उपयोगकर्ता सामग्री का व्यवसायिक उद्देश्यों के लिए सभी मीडिया चैनलों पर उपयोग, पुनरुत्पादन, संशोधन, वितरण, प्रदर्शन और शोषण कर सके।

3.5.2 आप यह प्रतिनिधित्व और वारंटी देते हैं कि आप उपयोगकर्ता सामग्री के एकमात्र स्वामी हैं या सभी आवश्यक अधिकार रखते हैं और यह कि आपकी उपयोगकर्ता सामग्री किसी तृतीय-पक्ष के अधिकारों (जैसे बौद्धिक संपदा, गोपनीयता या प्रचार अधिकार) का उल्लंघन नहीं करती।

3.5.3 आप अवैध, मानहानिकारक, अश्लील, आपत्तिजनक या अन्यथा अनुचित सामग्री प्रदान नहीं करेंगे। MILES GO RIDE अपने विवेक से उपयोगकर्ता सामग्री की समीक्षा, निगरानी या हटाने का अधिकार (लेकिन दायित्व नहीं) सुरक्षित रखता है।

3.6 नेटवर्क एक्सेस और डिवाइस

3.6.1 सेवाओं का उपयोग करने के लिए आवश्यक डेटा नेटवर्क एक्सेस सुरक्षित करने की जिम्मेदारी केवल आपकी है। मोबाइल डेटा शुल्क, SMS शुल्क और अन्य कनेक्टिविटी लागतें आपकी जिम्मेदारी होंगी।

3.6.2 सेवाओं तक पहुँचने के लिए आवश्यक संगत उपकरणों की खरीद और अद्यतन करना आपकी जिम्मेदारी है। MILES GO RIDE यह गारंटी नहीं देता कि सेवाएँ सभी उपकरणों या ऑपरेटिंग सिस्टम पर कार्य करेंगी और इंटरनेट या इलेक्ट्रॉनिक संचार विफलताओं के कारण होने वाली किसी भी डाउनटाइम, विलंब या त्रुटियों के लिए उत्तरदायी नहीं होगा।

4. भुगतान (Payment)

4.1 शुल्क (Charges)

आप स्वीकार करते हैं कि सेवाओं के उपयोग से तृतीय-पक्ष प्रदाताओं (“Charges”) द्वारा प्रदान की गई सेवाओं या वस्तुओं के लिए शुल्क लग सकते हैं। Miles Go Ride आपके लिए इन शुल्कों का भुगतान तृतीय-पक्ष प्रदाता की ओर से वसूल करेगा। इस प्रकार किया गया भुगतान सीधे तृतीय-पक्ष प्रदाता को किए गए भुगतान के समान माना जाएगा। शुल्क में लागू कर (Taxes) शामिल हैं। सभी भुगतान अंतिम और अप्रतिदेय (Non-Refundable) हैं, सिवाय जब Miles Go Ride अपने विवेक से रिफंड प्रदान करे।

4.2 भुगतान प्रक्रिया (Payment Process)

सभी शुल्क सेवा पूर्ण होने पर तुरंत देय होंगे। भुगतान Miles Go Ride द्वारा प्रोसेस किया जाएगा और आपको ई-रसीद उपलब्ध कराई जाएगी।

4.3 शुल्क में बदलाव (Modification of Charges)

Miles Go Ride समय-समय पर शुल्क तय करने, संशोधित करने या हटाने का अधिकार सुरक्षित रखता है। शुल्क मांग, स्थान या अन्य कारकों के आधार पर बदल सकते हैं। ऑफ़र/डिस्काउंट केवल उन्हीं यूज़र्स पर लागू होंगे जिनके लिए विशेष रूप से घोषित किए गए हों।
वॉलेट, वाउचर या डिस्काउंट केवल एडवांस बुकिंग राशि पर लागू होंगे, पूरे किराए पर नहीं।

4.4 उपहार राशि (Gratuities)

Miles Go Ride ड्राइवरों के लिए किसी भी भुगतान को टिप/ग्रेसुएटी के रूप में निर्धारित नहीं करता। यदि आप चाहें तो अपनी इच्छा से ड्राइवर को टिप दे सकते हैं।

4.5 अनधिकृत भुगतान (Unauthorized Payments)

आपको ड्राइवर/तृतीय-पक्ष प्रदाता को सीधे नकद/भुगतान करने की अनुमति नहीं है। यदि ऐसा होता है तो Miles Go Ride उसकी कोई जिम्मेदारी नहीं लेगा।

4.6 अतिरिक्त शुल्क (Taxes, Tolls, Parking)

यात्रा के दौरान लगने वाले टोल, पार्किंग, स्टेट टैक्स आदि का भुगतान आपको सीधे ड्राइवर/प्रदाता को करना होगा।

4.7 अधूरी यात्रा (Shortened Trips)

यदि आप यात्रा बीच में ही समाप्त करते हैं, तो भी पूरे पैकेज का भुगतान करना होगा।

4.8 बढ़ी हुई यात्रा (Extended Trips)

• रात 12 बजे से सुबह 3 बजे तक: प्रति घंटा ₹250 अतिरिक्त।
• 3 बजे के बाद: पूरे दिन का अतिरिक्त किराया (250 km × लागू प्रति km दर) लागू होगा।

4.9 अतिरिक्त सेवाएँ (Add-on Services)

• Add-on सेवाओं के शुल्क अप्रतिदेय हैं।
• यदि Add-on सेवा प्रदान नहीं की जाती, तो केवल उसका शुल्क वापस किया जाएगा।

4.10 मरम्मत और सफाई शुल्क (Repair/Cleaning Fees)

यदि आपके कारण वाहन को अतिरिक्त मरम्मत/सफाई की आवश्यकता होती है तो उसका खर्च आप पर डाला जाएगा।
पेट्स के साथ यात्रा करने पर अतिरिक्त सफाई शुल्क लागू होंगे।

4.11 सेल्स पार्टनर कमीशन (Sales Partner Commission)

• कमीशन दरें Miles Go Ride द्वारा बदली जा सकती हैं।
• केवल पूरी हुई यात्राओं पर कमीशन दिया जाएगा।
• न्यूनतम निकासी सीमा: ₹2000।
• कमीशन के लिए पैन कार्ड और बैंक डिटेल अनिवार्य हैं।

5. अस्वीकरण, दायित्व की सीमा और क्षतिपूर्ति

5.1 अस्वीकरण (Disclaimer)

• सेवाएँ “जैसी हैं” और “उपलब्धता के अनुसार” आधार पर प्रदान की जाती हैं।
• Miles Go Ride सेवा की गुणवत्ता, उपलब्धता, विश्वसनीयता की गारंटी नहीं देता।
• तृतीय-पक्ष प्रदाताओं द्वारा दी जाने वाली सेवाओं की सुरक्षा/क्वालिटी की कोई गारंटी नहीं है।

5.2 दायित्व की सीमा (Limitation of Liability)

• Miles Go Ride किसी भी प्रकार की अप्रत्यक्ष, विशेष या परिणामस्वरूप हानि (जैसे लाभ की हानि, डेटा का नुकसान, व्यक्तिगत चोट, संपत्ति क्षति) के लिए जिम्मेदार नहीं होगा।
• किसी भी परिस्थिति में Miles Go Ride की अधिकतम जिम्मेदारी ₹500 तक सीमित होगी।
• यदि आप सत्यापित वाहन/ड्राइवर के बजाय किसी और के साथ यात्रा करते हैं, तो सभी परिणामों के लिए आप स्वयं जिम्मेदार होंगे और न्यूनतम ₹10,000 का जुर्माना लागू होगा।

5.3 क्षतिपूर्ति (Indemnity)

आप सहमत हैं कि आप Miles Go Ride, उसके निदेशक, कर्मचारी, और एजेंटों को किसी भी दावे, नुकसान, या कानूनी कार्रवाई से मुक्त रखेंगे, यदि यह आपके:

1. सेवाओं के उपयोग,
2. शर्तों के उल्लंघन,
3. आपके द्वारा दी गई सामग्री,
4. या किसी तीसरे पक्ष के अधिकारों के उल्लंघन से उत्पन्न हो।

6. लागू कानून और मध्यस्थता (Governing Law; Arbitration)

6.1 ये नियम भारत के कानूनों के अनुसार संचालित और व्याख्यायित किए जाएंगे।

6.2 इन नियमों से संबंधित किसी भी विवाद, दावा, या मतभेद (“विवाद”), जिसमें इनके उल्लंघन, समाप्ति, प्रवर्तन, व्याख्या या वैधता, या साइट, एप्लिकेशन या सेवाओं का उपयोग शामिल है, को पहले आपसी बातचीत और परामर्श द्वारा मैत्रीपूर्ण तरीके से हल करने का प्रयास किया जाएगा। इसके लिए Miles Go Ride द्वारा निर्दिष्ट कार्यालय स्थान पर बैठक की जाएगी।

6.3 यदि बातचीत के 30 (तीस) दिनों के भीतर विवाद हल नहीं होता है, तो ऐसे विवाद को Arbitration and Conciliation Act, 1996 (जैसा समय-समय पर संशोधित किया गया है) के प्रावधानों के अनुसार मध्यस्थता द्वारा सुलझाया जाएगा। यदि यह अधिनियम प्रभावी नहीं रहता, तो उस समय भारत में लागू मध्यस्थता कानून के अनुसार समाधान किया जाएगा।

6.4 मध्यस्थता की प्रक्रिया (Arbitration Proceedings):

• प्रत्येक पक्ष एक-एक मध्यस्थ नियुक्त करेगा और दोनों द्वारा नियुक्त मध्यस्थ मिलकर एक तीसरे/प्रधान मध्यस्थ को नियुक्त करेंगे।
• मध्यस्थता का मुख्यालय और स्थान अहमदाबाद, गुजरात, भारत होगा।
• मध्यस्थता की कार्यवाही अंग्रेजी/हिंदी/गुजराती भाषा में होगी।

6.5 उपरोक्त मध्यस्थता प्रावधानों के अधीन, इन नियमों से उत्पन्न या इनके संबंध में सभी मामलों पर अहमदाबाद, गुजरात, भारत के न्यायालयों का विशेष अधिकार क्षेत्र (exclusive jurisdiction) होगा।

7. अन्य प्रावधान (Other Provisions)

7.1 कॉपीराइट उल्लंघन के दावे (Claims of Copyright Infringement):
यदि सेवाओं से संबंधित किसी भी कॉपीराइट उल्लंघन का दावा है, तो उसे Miles Go Ride को भेजा जाना चाहिए। अधिक जानकारी और निर्दिष्ट पते के लिए कृपया www.milesgoride.com देखें।

7.2 सूचनाएँ (Notices):

• Miles Go Ride आपको निम्नलिखित तरीकों से सूचना दे सकता है:
  • सेवाओं पर सामान्य सूचना पोस्ट करके,
  • आपके अकाउंट में पंजीकृत ईमेल पते पर ईमेल भेजकर,
  • आपके अकाउंट में पंजीकृत मोबाइल नंबर पर SMS भेजकर,
  • या आपके अकाउंट में दिए गए पते पर लिखित संचार भेजकर।
• आप Miles Go Ride को ईमेल द्वारा सूचना भेज सकते हैं: support@milesgoride.com

7.3 सामान्य प्रावधान (General):

• आप इन नियमों को, पूर्ण या आंशिक रूप से, Miles Go Ride की पूर्व लिखित सहमति के बिना स्थानांतरित या सौंप नहीं सकते।
• Miles Go Ride इन नियमों को, पूर्ण या आंशिक रूप से, बिना किसी प्रतिबंध के स्थानांतरित कर सकता है, जिसमें शामिल हैं:
  (i) इसकी सहायक या संबद्ध कंपनी (subsidiary or affiliate),
  (ii) Miles Go Ride के शेयर, व्यवसाय या संपत्तियों का अधिग्रहण करने वाला, या
  (iii) विलय (merger) के माध्यम से उत्तराधिकारी संस्था।
• इन नियमों या सेवाओं के उपयोग के परिणामस्वरूप आपके, Miles Go Ride, या किसी तृतीय-पक्ष प्रदाता के बीच कोई संयुक्त उद्यम, साझेदारी, रोजगार, या एजेंसी संबंध अस्तित्व में नहीं आता।

अन्य नियम एवं शर्तें (Other Terms & Conditions)

• कभी भी ऐसे वाहन में यात्रा न करें जिसका वाणिज्यिक (Commercial) लाइसेंस मान्य न हो।
• यदि वाहन और ड्राइवर की जानकारी आपके पास उपलब्ध विवरण से मेल नहीं खाती हो तो यात्रा न करें।
• यदि आप बिना वाणिज्यिक लाइसेंस वाले वाहन में या असाइन किए गए ड्राइवर के अतिरिक्त किसी अन्य ड्राइवर के साथ यात्रा करना चुनते हैं तो इसके लिए Miles Go Ride किसी भी प्रकार से जिम्मेदार या उत्तरदायी नहीं होगा।
• एक बार जब आपने यात्रा शुरू होने से पहले वाहन और ड्राइवर का सत्यापन (verification) कर लिया, तो Miles Go Ride केवल उसी ड्राइवर के लिए जिम्मेदार होगा जिसे आपके लिए असाइन किया गया है। ड्राइवर के साथ मिलान (matching) के बाद, यात्रा के दौरान होने वाली किसी भी घटना के लिए Miles Go Ride जिम्मेदार नहीं होगा।

अतिरिक्त शर्तें

• ड्राइवर सत्यापन (Driver Verification): यात्रा शुरू करने से पहले ड्राइवर आपका पहचान पत्र (जैसे आधार कार्ड, पैन कार्ड) देखने का अनुरोध कर सकता है।
• एक दिन की परिभाषा (Definition of a Day): एक दिन का अर्थ है पूरा कैलेंडर दिवस (रात 12:00 बजे से अगले दिन रात 12:00 बजे तक)।
• दूरी की गणना (Distance Calculation): दूरी गूगल मैप्स के आधार पर यात्रा मार्ग और स्थान अनुसार मापी जाएगी। यदि यात्रा की गई दूरी बुक किए गए किलोमीटर से अधिक है, तो अतिरिक्त किलोमीटर का शुल्क मानक दरों के अनुसार लिया जाएगा।
• टोल, राज्य कर एवं पार्किंग (Toll, State Tax, and Parking): सभी टोल टैक्स, राज्य (बॉर्डर) टैक्स और पार्किंग शुल्क ग्राहक द्वारा वास्तविक आधार पर भुगतान किया जाएगा। बुकिंग राशि में ये शामिल नहीं हैं। हवाई अड्डा प्रवेश शुल्क, पार्किंग या प्रवेश शुल्क भी ग्राहक की जिम्मेदारी होगी।
• सामान और यात्री (Luggage and Passengers): वाहन श्रेणी (vehicle category) में निर्धारित सीमा से अधिक अतिरिक्त यात्री या सामान की अनुमति नहीं है।
• वाहन मॉडल गारंटी (Vehicle Model Guarantees): बुकिंग के समय Miles Go Ride केवल वाहन की श्रेणी सुनिश्चित करता है, किसी विशेष वाहन मॉडल की उपलब्धता की गारंटी नहीं देता। यदि कोई विशेष मॉडल उपलब्ध न हो या प्रदान न किया जाए तो इसके लिए कोई रिफंड (Refund) नहीं दिया जाएगा।
• ड्राइवर भोजन (Driver Meals): यात्रा के दौरान ड्राइवर अपने भोजन की व्यवस्था स्वयं करेगा।
• ग्राहक का आचरण (Customer Conduct): कृपया ड्राइवर को तेज गाड़ी चलाने के लिए मजबूर न करें। सभी यात्रियों की सुरक्षा सर्वोपरि है।
• भुगतान (Payment): शेष भुगतान यात्रा प्रारंभ होने के समय देय होगा।
• हानि एवं क्षति (Loss & Damages): Miles Go Ride अपनी सेवाओं के उपयोग से होने वाली किसी भी भौतिक या अभौतिक हानि के लिए जिम्मेदार नहीं है। ऐसी हानियों के लिए कोई क्षतिपूर्ति नहीं दी जाएगी।
• किराया गणना (Fare Calculations): वन-वे या राउंड-ट्रिप किराया विभिन्न शर्तों के अधीन है और कुछ राज्यों व पर्यटक स्थलों के लिए अलग हो सकता है। किसी भी अतिरिक्त पिकअप या ड्रॉप पॉइंट पर अतिरिक्त शुल्क लिया जाएगा।
• अतिरिक्त शुल्क (Additional Charges): यात्रा के दौरान होने वाले सभी अतिरिक्त खर्चे व शुल्क जो बुकिंग में शामिल नहीं हैं, उनकी जिम्मेदारी ग्राहक की होगी।
